Common use of Right to enter into Deed(s) of Grant of Easement Clause in Contracts

Right to enter into Deed(s) of Grant of Easement. Without prejudice to the generality of sub-clause (m) and (n) above and subject to the prior written approval of the Owners’ Committee or the Owners’ Corporation (if formed), the right, with or without joining any Owner, to enter into the Deed(s) of Grant of Easement or any other deed or deeds of grant of easement in favour of the owners and/or occupiers of neighbouring premises or to release or extinguish such Deed(s) of Grant of Easement and/or the Deed of Mutual Grant and any easement or right of way exercisable by the Owners of the Land over any neighbouring premises at any time or times and on such terms and subject to such conditions and with such party or parties as the First Owner may deem appropriate, and to enter into any deed or deeds, at any time or times, to vary, amend or otherwise alter the terms, conditions or covenants of or contained in the Deed(s) of Grant of Easement and/or the Deed of Mutual Grant or such deed or deeds so long as the same does not or do not affect the right of any Owner to the exclusive use and occupation of his Unit and does not impede or restrict the access to and from any part or parts of the Building and the Land and PROVIDED THAT all monetary consideration (if any) received therefor pursuant to this sub-Clause shall be paid into the Special Fund.

Without prejudice to the generality of sub-clause clauses (m) and (n) above and subject to the prior written approval of the Owners' Committee or the Owners' Corporation (if formed)) or by a resolution of the Owners at an Owners’ meeting convened under this Deed, the right, with or without joining any Owner, to enter into the Deed(s) of Grant of Easement or any other deed or deeds of grant of easement in favour of the owners and/or occupiers of neighbouring premises or to release or extinguish such Deed(s) of Grant of Easement and/or the Deed of Mutual Grant and any easement or right of way exercisable by the Owners of the Land over any neighbouring premises at any time or times and on such terms and subject to such conditions and with such party or parties as the First Owner may deem appropriate, and to enter into any deed or deeds, at any time or times, to vary, amend or otherwise alter the terms, conditions or covenants of or contained in the Deed(s) of Grant of Easement and/or the Deed of Mutual Grant or such deed or deeds so long as the same does not or do not affect the right of any Owner to the exclusive use and occupation of his Unit and does not impede or restrict the access to and from any part or parts of the Building and the Land and PROVIDED THAT all monetary consideration (if any) received therefor pursuant to this sub-Clause clause shall be paid into the Special Fund.
