Common use of Right to Reject or Stop the Work Clause in Contracts

Right to Reject or Stop the Work. The University may reject any of the work which does not conform to the Project Documents. If the ESCO fails to correct defective work or fails to supply labor, materials or equipment in accordance with the Project Documents or to execute the work in a workmanlike manner, the University may order the ESCO to stop the work, or any portion thereof, until the cause for such order has been eliminated. Notwithstanding the preceding, the ESCO shall retain exclusive control over all duties and responsibilities.
