Common use of Right to Updates and Upgrades Clause in Contracts

Right to Updates and Upgrades. This license entitles Customer to receive any and all standard patches, fixes, and modifications ("Updates") made to the Service during Customers subscription term free of charge, so long as DARUMA, in its sole discretion, includes such Updates in a release provided to all users of the Service. Notwithstanding the previous sentence, DARUMA reserves the right to charge fees before granting Customer access to any new versions of the Service, or premium (i.e., paid for) feature improvements, enhancements or add-ons to the Services ("Upgrades"). Customer understands that DARUMA may make Updates to the Services and their related software at any time, in its sole discretion, but is under no obligation to inform Customer of any such Updates. To the extent that DARUMA supplies any Updates or Upgrades to Customer, they will be deemed to be subject to this Agreement, unless DARUMA indicates otherwise.
