Rights and Limits. 1. An employee covered by this Agreement and/or the Association shall present grievances in accordance with these procedures. An employee has the right to adjust individual grievances with or without Association representation. 2. The failure of an employee or the Association to act on any grievance within the prescribed time limits will act as a bar to any further appeal. An administrator's failure to give a decision within the time limits shall permit the grievant to proceed to the next step. The time limits, however, may be extended by mutual agreement. 3. It is agreed that any filing, investigation, handling, or other processing of any grievance by the grieving employee or Association shall be conducted so as to result in no interference with or interruption of the instructional program or other assigned duties of the grieving employee and any or all of the employees. Time before school, after school, during the lunch period, planning period, or during a contract non-teaching workday shall be used. 4. If the Association or any employee files any claim or complaint in any manner other than under the grievance procedure of this Agreement, then the District shall not be required to process the same claim or set of facts through the grievance procedure. 5. All records dealing with the processing of a grievance shall be filed only in separate grievance files.

Insofar as practicable, all parties on the work which may be in progress have equal rights to use of roads and ground at the site, but in no case will the Seller be permitted to use any of the facilities, such as roads, utilities, and buildings erected or constructed by another party at the site without prior consent of the party involved and the approval of Buyer. c. Crossing facilities provided by Buyer, insofar as practical, may be used by any and all parties working the building or area involved. However, in no case will such crossing be installed and maintained for the exclusive use of the party responsible for the isolation or obstruction. d. Temporary bridges and crossings provided by the Seller for his own use shall be constructed and maintained in complete conformity with the applicable requirements of theSecurity and Safety” section of the specification and state laws and local codes governing such structures.

Rights and Limits. 2.1 Syntax-Brillian is the developer of the Products and shall be responsible for providing the specifications and bills of materials to Manufacturer. The package for the goods is part of the b▇▇▇ of material and therefore controlled by Syntax-Brillian as any other component on the b▇▇▇ of materials. Syntax-Brillian shall be responsible for providing requirement forecasts, placing orders for the Products, providing product warranty, interfacing with customers and performing after-sale services. 2.2 Manufacturer shall assemble and test the Products and provide necessary repairs, in accordance with the instructions in the orders placed by Syntax-Brillian. Pursuant to the instruction of Syntax-Brillian, Manufacturer shall be responsible for the sourcing and payments for the display panels and any and all components required to make the Product. Original Materials and Special Materials shall be used in assembling the Products. 2.3 The OEM relationship under this Agreement is based upon Syntax-Brillian’s confidence in Manufacturer’s sophistication and experience in manufacturing. Without Syntax-Brillion’ s prior written consent, Manufacturer may not assign to any third party the manufacturing under this Agreement provided that Manufacturer could assign the manufacturing to its China and Vietnam subsidiaries. 2.4 Manufacturer shall neither manufacture nor sell the Olevia-trademarked Products to any third party or for its own accounts. This shall include any Products that utilize or include any unique designs or tooling created for the Syntax-Brillian Products. 2.5 The Product and any change to the Product made in accordance with this Agreement are subject to an acceptance test by Syntax-Brillian before acceptance. Syntax-Brillian may in its sole discretion reject any portion of any shipment of Product which is not conforming with the Specifications. Should such testing indicate a likelihood of more than a minimal number of failures of the Products delivered to comply with the warranty provided herein, Syntax-Brillian may, at Manufacturer’s expense, return the entire Product shipment for further testing by Manufacturer.

You can end this license for specific content by deleting such content from the Services, or generally by closing your account, except (a) to the extent you shared it with others as part of the Service and they copied, re-shared it or stored it and (b) for the reasonable time it takes to remove from backup and other systems. 2. You also agree that your profile information will be truthful. Evercare may be required by law to remove certain information or content in certain countries.

  • Rights and Licenses The W ork is made up of intellectual property that may fall into four categories: (1) Your Manuscript; (2) Our W ork Product; (3) Our Property; and (4) Third Party Property. Your Manuscript includes the text of the W ork, in its original form as submitted by You and as edited by Us during the fulfillment of editorial Services purchased by You, and graphics or other materials, all owned or authorized in writing by the owners to be submitted by You to be incorporated into the W ork. YOU (AND/ OR THE PERSONS YOU ARE EXCLUSIVELY AUTHORIZED TO REPRESENT IN THIS AGREEMENT) WILL REMAIN THE SOLE AND EXCLUSIVE OWNER(S) OF ALL RIGHT, TITLE, AND INTEREST, INCLUDING COPYRIGHT, IN AND TO YOUR MANUSCRIPT. Our W ork Product includes the book design, book cover design, graphics, Illustrations (as defined below), and other content that W e or Our Contractors create in the process of fulfilling the Services (with the exception of the text of the W ork). Our Property includes Our intellectual property, such as imprint logos, imprint names, trademarks, barcodes, and ISBN's.   • Exceptions and Limitations For the avoidance of doubt, where Exceptions and Limitations apply to Your use, this Public License does not apply, and You do not need to comply with its terms and conditions.
