Rights and Remedies Not Waived. Contractor covenants that the provision of services to be performed by Contractor under this Agreement shall be completed without compensation from the MVEMSA, except as specified herein. The acceptance of work under this Agreement shall not be held to prevent maintenance of an action for failure to perform work in accordance with this Agreement.
