Common use of Risk of Nonpayment Clause in Contracts

Risk of Nonpayment. The CM shall not commence any portion of the Work requiring Shop Drawings, Product Data, Samples, or other submittals until the submittal has been approved by the A/E. If the CM starts Work before the A/E’s final approval of the submittal, the CM does so at its own risk that payment may not be approved by the Contracting Authority or made by the Owner for the related Work.
