ROOM SERVICE. (a) Room Service Servers and Bus Persons shall be responsible for delivery and removal of service to and from hotel rooms, provided, however, that Guest Room Attendants, while cleaning rooms, may be required to remove such service from the rooms to the hall immediately outside the rooms. A service charge of ten percent (10%) of the check shall be paid to Room Service Servers for setting up for cocktail parties/hospitalities in private rooms. For purposes of this Section, a cocktail party/hospitality is a gathering of ten (10) or more persons in a private room or suite in which alcoholic beverages, mixes, glasses, ice or food are delivered by the Room Service Server. A service charge of one dollar thirty-five cents ($1.35) for each delivery made by a Room Service Server or Bus Person shall be paid for delivering complimented items such as liquor or fruit and other similar items, but excluding meals and beverages served with meals, sent to the guest room by the Employer. It is agreed that Bartenders may work four (4) hour shifts for cocktail parties/hospitalities in suites and be paid at the Banquet Bartender rate. (b) The current practice with respect to the amount and distribution of room service gratuities shall be continued at the Employer for the term of this collective bargaining agreement. The Employer may utilize room service bus persons to deliver complimented items in accordance with Section 16.07(a). Where the complimented item(s) to be delivered requires more than normal set up by the Server, for example, leave the room service area to prepare the complimented item(s) or prepare the complimented item(s) in the room service area, the Server will be guaranteed a gratuity of five dollars ($5.00) per delivery. Where the Food Server is required to deliver the complimented item(s) and service the guest for the event in the room, the Food Server shall be guaranteed a gratuity of fifteen percent (15%) of the menu price of the food and beverage served with a cap of one hundred fifty dollars ($150) per Server who actually performed the work.

Where the Food Server is required to deliver the complimented item(s) and service the guest for the event in the room, the Food Server shall be guaranteed a gratuity of fifteen percent (15%) shall be shown on the guest’s check for Room Service orders, with understanding that non-payment of all/any service charge to the Hotel by the guest will be recoverable from the employee.
35.2 One hundred percent (100%) of the menu price gratuity from any function held in a hotel suite or private room, that is sold through sales and catering, shall be paid to the unionized staff servicing the function.
35.3 The Hotel will continue its past practice currently in effect with regards to the taking and delivery of room service orders, as between the Service One and Room Service departments.
35.4 Pre-organized Meetings that do not have a meal, coffee break or reception but have been organized through the Sales and Catering Department and at the last minute decide they require Meal/Food service in the meeting room will order the Meal/Service through the Room Service Department. This is considered a Room Service order and one hundred percent (100%) of the food room service gratuity will go to the Room Service Servers.
35.5 Any special setup and beverage served with service in a cap guest room that is on a BEO will be set up and serviced by a Banquet Houseperson. The Banquet Houseperson and Room Service Server will share the fifteen percent (15%) gratuity (one percent [1%] to the Houseperson and fourteen percent [14%] to the Room Service Server). This Article is to clarify the position of Room Service areas of operation. All functions held in private guest rooms where a Catering/Function sheet has been distributed outlining service and product requirements will be the responsibility of the Room Service Department, for staffing, billing and gratuity distribution. If through staffing shortfalls additional people are required, the first option will be given to Room Service attendants to work additional hours. If the individuals at their requests go over eight (8) hours per day, it is understood that it will be paid at straight time and not overtime. If the individual at their request works sixth (6th) and seventh (7th) days, this will also be paid at straight time. It is also understood that Banquet Staff will not be required to service regular Room Service duties while Room Service attendants serve a private room function. The Hotel reserves the right in cases of ethnic services and language requirements to utilize Katsura staff for the service of any function in a private guest room, as long as there is minimum of one hundred fifty dollars (1) Room Service attendant per private function. When ethnic service and language is not a necessity, the operation of the function will include Room Service attendants. NOTE: Gallery 900 is no longer a guest room and is not subject to the terms of this Article.
35.6 The Parties hereby agree that the Company will pay effective the date of ratification one dollar and seventy-five cents ($1501.75) per Server who actually performed the workfavour form, per delivery, per room for all complimentary items.
