ROOMS ATTRITION. Hotel is relying on University to use <NUMBER> Total Room Nights. «ACCOUNT» agrees that a loss will be incurred by Hotel should there be a reduction greater than 20% in Total Room Nights used. Should the room nights actually used by University be less than 80% of the Total Room Nights, University agrees to pay, as liquidated damages and not as a penalty, the difference between 80% of the Total Room Nights and University‘s actual usage of rooms multiplied by the rate quoted in this contract plus any applicable taxes. Should the Hotel determine that any portion of Group’s Room Block not confirmed as of the Reservation Cut-Off date is available for resell, the Hotel will attempt to sell the unused portion of the Room Block and, if a Group room is resold, Group’s attrition charges shall be reduced by the room rate received on each Group room sold, up to the rate for said room set forth in this Agreement in accordance with Room Block Attrition paragraphs above. If unused Group rooms are returned to Hotel inventory for attempted resale, Group rooms shall be the last in the Hotel’s inventory to be sold.
ROOMS ATTRITION. The group will be allowed to reduce the outlined guest room block by 20% Attrition charges will be calculated individually by day, not on a cumulative basis. All final room nights consumed will be credited toward the minimum room night commitment including reservations made after the cut-off date. If group’s usage falls below the outlined reduction, the group will be responsible for the difference between actual usage and the attrition outlined, plus applicable taxes. The group will guarantee revenue as follows: $3,297.60 for March 29, 2023 $3,297.60 for March 30, 2023 Reservations by Group and attendees against the Guest Room Commitment must be received on or before Monday, February 27, 2023 (the “Cut-Off Date”). At the Cut-Off Date, Hotel will review the reservation pickup for the Event; unreserved group rooms will be released back into the Hotels inventory for general sale. The release of the Group’s guest rooms for general sale following the Cut-Off Date does not alter, adjust, or affect Group’s obligation with respect to, the Guest Room Commitment. Should the Group elect to utilize the 10% reduction of the contracted room revenue, the Group must notify the Hotel by the Cut-Off Date in writing. If Group does not notify Hotel in writing by the Cut-Off Date of their intent of reduction, they have waived the right of reduction.
ROOMS ATTRITION. Hotel is relying upon Screen Gems Louisiana, LLC’s use of the Room Night Commitment. Screen Gems Louisiana, LLC agrees that a loss will be incurred by Hotel if Screen Gems Louisiana, LLC’s -Screen Gems Louisiana, LLC actual usage is less than seventy percent (70%) of the Total Room Night Commitment. If Screen Gems Louisiana, LLC’s actual usage is less than seventy percent (70%) of the total Room Night Commitment, Screen Gems Louisiana, LLC-When the Bough Breaks agrees to pay, as liquidated damages and not as a penalty; which shall be calculated as follows: 3,011 X 70% = 2,108 total room nights. 2,108 X $89 = $187,612 The difference between an amount equal to seventy percent (70%) of the Room Night Commitment, less Screen Gems Louisiana, LLC’s actual usage of the Room Night Commitment, with the result multiplied by the average Screen Gems Louisiana, LLC-When the Bough Breaks rate ($89 per studio or one bedroom suite and $129 per two bedroom suite), plus applicable tax. Hotel agrees that in such an event, it shall not be entitled to charge any sums in excess of the attrition liquidated damages. In the event Hotel achieves one-hundred percent (100%) occupancy during the Official Program Dates (notwithstanding Screen Gems Louisiana, LLC’s usage of less than seventy percent (70%) of the Total Room Night Commitment), no attrition liquidated damages shall be payable. Hotel will use good faith effort to mitigate its damages. Hotel will make a reasonable and good faith effort to resell rooms released and credit the Screen Gems Louisiana, LLCSony Entertainment-When the Bough Breaks for all rooms resold. No room shall be deemed to have been resold unless and until the Hotel first sells all of the rooms (excluding those which are out of service), outside of the room block.

Columbia Pictures agrees that a loss will be incurred by Hotel should there be a reduction greater than 30% in Total Room Nights used. Should the room nights actually used by Columbia Pictures be less than 70% of the Total Room Nights, Columbia Pictures agrees to pay, as liquidated damages and not as a penalty, the difference between 70% of the Total Room Nights and Columbia Picture‘s actual usage of rooms multiplied by the average group rate plus any applicable taxes. Should the Hotel determine that any portion of Group’s Room Block not confirmed as of the Reservation Cut-Off date is available for resell, the Hotel will attempt to sell the unused portion of the Room Block and, if a Group room is resold, Group’s attrition charges shall be reduced by the room rate received on each Group room sold, up to the rate for said room set forth in this Agreement in accordance with Room Block Attrition paragraphs above. Company agrees that a loss will be incurred by Hotel if Company’s actual usage is less than [80] % of the Room Night Commitment. If Company’s actual usage is less than [80]% of the Room Night Commitment, Company agrees to pay, as liquidated damages and not as a penalty, the difference between [80]% of the Room Night Commitment and Company’s actual usage, multiplied by the average group room rate, plus applicable taxes.
ROOMS ATTRITION. Hotel is relying upon American Association of Avian Pathologists’ nightly use of the Room Night Commitment and, if applicable, the Minimum Banquet Food and Beverage Revenue. American Association of Avian Pathologists agrees that a loss will be incurred by Hotel if American Association of Avian Pathologists’ actual usage is less than eighty five percent (85%) of the Room Night Commitment on any night of the Event. The attrition allowance applies to run of house guestrooms, upgrades at the group rate and staff guestrooms, but excludes any contracted Sawgrass Signature rooms. Hotel agrees to allow for a fifteen percent (15%) reduction in the nightly Room Night Commitment. Each night during the Event, Hotel will subtract the actual room usage for that night and the amount of permissible attrition for that night from the Room Night Commitment for that night. The difference of room nights will be multiplied by the group’s average room rate (excluding staff and or complimentary rooms) and the resulting amount will be posted as charges to American Association of Avian Pathologists’ Master Account, plus applicable taxes, at the conclusion of the Event. Additionally, at the conclusion of the Event, if the actual banquet food and beverage revenue is less than the Minimum Banquet Food and Beverage Revenue, forty percent (40%) of the difference will be posted to the Master Account. These charges represent a reasonable effort on behalf of the Hotel to establish its loss prospectively and shall be due as liquidated damages.
ROOMS ATTRITION. Hotel is relying on Association of Florida Colleges Foundation to use 244 Total Room Nights. Association of Florida Colleges Foundation agrees that a loss will be incurred by Hotel should there be a reduction greater than 20% in Total Room Nights used. Should the room nights actually used by Association of Florida Colleges Foundation be less than 80% of the Total Room Nights (195 room nights), Association of Florida Colleges Foundation agrees to pay, as liquidated damages and not as a penalty, the difference between 80% of the Total Room Nights and Association of Florida Colleges Foundation‘s actual usage of rooms multiplied by the average group rate plus any applicable taxes. Should the Hotel determine that any portion of Group’s Room Block not confirmed as of the Reservation Cut-Off date is available for resell, the Hotel will attempt to sell the unused portion of the Room Block and, if a Group room is resold, Group’s attrition charges shall be reduced by the room rate received on each Group room sold, up to the rate for said room set forth in this Agreement in accordance with Room Block Attrition paragraphs above. ROOMS ATTRITION. Overeaters Anonymous NC State Convention 2020 agrees that it will pay Hotel $95.00 for each room night not utilized below 50 room nights, plus applicable taxes, as a reasonable estimate of the harm the attrition will cause the Hotel. Hotel agrees that after receiving this payment, it will not seek additional damages.

National Association of Lease and Title Analysts agrees that a loss will be incurred by Hotel if National Association of Lease and Title Analysts’ actual usage is less than 80% of the Room Night Commitment. If National Association of Lease and Title Analysts’ actual usage is less than 80%of the Room Night Commitment, National Association of Lease and Title Analysts agrees to pay, as liquidated damages and not as a penalty, the difference between 80%of the Room Night Commitment and National Association of Lease and Title Analysts’ actual usage, multiplied by the average group room rate, plus applicable taxes. Hotel is pleased to offer the use of our online group reservations system powered by Passkey. A room list is to be provided by the meeting planner or designate, by the cutoff date of Friday, May 30, 2014 in the Hotel room list format for automatic upload into Passkey. The planner will be given access to make, modify or cancel reservations after the first list is uploaded and/or Hotel will publish a website for attendees to access to manage their modifications or changes themselves. Reservations must be made on or before the cutoff date of Friday, May 30, 2014 in order to be eligible for the group rate. Any reservations made after the Cutoff Date shall be at the Hotels then current available rate. Hotel will supply a username and password to provide you with 24/7 online access to your group’s information and reports.
ROOMS ATTRITION. Waived for Courtesy Block Hotel is relying upon Western Dredging Association’s use of the room night commitment. Western Dredging Association agrees that a loss will be incurred by the Courtyard by Marriott - Mag Mile if Western Dredging Association’s actual usage is less than 90% of the daily room nights actually used. Should the daily room nights actually be used by Western Dredging Association be less than 90% of the daily room night commitment, Western Dredging Association agrees to pay, as liquidated damages and not as a penalty, the difference between 90% of the daily room night commitment and Western Dredging Association’s actual usage of rooms, multiplied by the average Western Dredging Association room rate, plus applicable taxes. The parties agree that the Attrition Damages are reasonable estimates of the losses that would be incurred by Hotel and include consideration of the possibility of Hotel’s ability to mitigate its losses through resale.
