Common use of Rules as to Usage Clause in Contracts

Rules as to Usage. (a) The terms defined above in Section 1.1 and as defined in Appendix A have the meanings set forth therefor for the purposes of this Agreement, and such meanings are equally applicable to both the singular and plural forms of the terms defined. (b) Unless otherwise expressly provided herein "including" (and with correlative meaning "include") means including without limitation or including without limiting the generality of any description preceding such term. (c) A reference to writing includes typewriting, printing, lithography, photography and any other mode of representing or reproducing words, figures or symbols in a lasting and visible form. (d) Unless otherwise expressly provided herein, any agreement, instrument, approval, deliverable (including Budgets) or Applicable Law defined or referred .to means such agreement, instrument, approval, deliverable or Applicable Law as from time to time amended, modified, novated or supplemented, including (in the case of agreements or instruments) by waiver or consent and (in the case of Applicable Law) by succession of comparable successor Applicable Law or modification in accordance with the terms of the Transaction Agreements and includes (in the case of agreements or instruments) references to all attachments thereto and instruments incorporated therein. (e) References to a Person are also to its permitted successors and permitted assigns. (f) Any term defined in a Transaction Agreement by reference to any agreement or instrument has such meaning whether or not such agreement or instrument is in effect.
