Common use of Rules/Laws Clause in Contracts

Rules/Laws. (a) All transactions shall be subject to the constitution, rules, regulations, customs, usages, rulings and interpretations, from time to time extant or in force of the Exchange or other markets (and of their respective clearing house, if any), where the transactions are executed by MeesPierson or MeesPierson agents. All transactions under this agreement shall also be subject to any law, rule, or regulation then applicable thereto, including but not by way of limitation, the provisions of the CTO, as amended from time to time, and the rules and regulations thereunder. (b) All transactions entered between MeesPierson and the Customer relating to any money, foreign currency, currency option, currency future, or currency forward contract or foreign exchange contract shall be governed by and subject to all the rules, regulations, orders and laws of the country of the currency or money concerned and those of Hong Kong and/or the by-laws, rules and regulations of the exchange concerned in which the transaction is done. (c) All transactions related to futures/options contracts executed in markets other than those organised by the Exchange will be subject to the rules and regulations of those markets and not those of the Exchange, with the result that the Customer may have a markedly different level and type of protection in relation to those transactions as compared to the level and type of protection afforded by the rules of the Exchange.
