Schedule of Rates. 3.1 The schedule of Rates shall be read in conjunction with all other sections of Bidding document. 3.2 The rates quoted by the bidder shall be firm and fixed for the completion period of the tendered works, unless stated otherwise. The rates quoted by the Bidder shall include all taxes, duties & levies except Service Tax and any cess thereon. Service Tax and cess thereon shall be paid by BCPL extra at actual against cenvat invoice to be submitted by the bidder. Notwithstanding the instructions given above, in case any bidder(s) mention the terms such as “Inclusive” or “Included” in respect of Service Tax, their bids will still be evaluated considering the prices exclusive of Service Tax. However, in the event of such bidder emerging as the lowest bidder based on this evaluation, the award shall be made considering the service tax included in the quoted rates and the same will be conclusive and binding on the bidder. Further, the bidder will be required to submit Cenvat invoice to enable BCPL to avail Cenvat benefit. 3.3 Rates must be filled in format for „schedule of rates‟ enclosed as part of bidding document. If quoted in separate typed sheets and any variation in description, unit is noticed, the bid is liable to be rejected. In any case bidder shall be presumed to have quoted against the description of work and the same shall be binding on the bidder. 3.4 In case any activity though specifically not covered in description of „Schedule of Rates‟ but is required to complete the work as per Scope of Work, Scope of Supply, Specifications, Standards, Drawings, General Conditions of Contract, Special condition of contract or any other part of bidding document, the quoted rates will deemed to be inclusive of cost incurred for such activity. 3.5 The rates shall include all expenditure incurred towards mobilization and demobilization. 3.6 Rates quoted shall be in Indian Rupees Only. 3.7 Bidder shall quote rates both in figures as well as in words.

Schedule of Rates. 3.1 The schedule This clause shall only apply where a Schedule of Rates forms part of a Purchase Order Contract. Essential Energy’s Representative is entitled to use the Schedule of Rates for the purposes of assisting Essential Energy’s Representative in the valuation of any payment claim. To the extent that the Purchase Order Price is ascertained by utilising the Schedule of Rates: (a) the Contractor shall have no Claim against Essential Energy, including any consultant of Essential Energy or Essential Energy’s Representative, with respect to any incorrect quantity included in the Schedule of Rates or any item which should not have been included or the omission of an (b) where any item in the Schedule of Rates is not priced by the Contractor or where an item has been omitted from the Schedule of Rates, the Contractor shall be read deemed nevertheless to have allowed for whatever remuneration it required or may require for such items within the rates or prices for other items which it priced in conjunction the Schedule of Rates. Each item in the Schedule of Rates shall, without limiting the above, be deemed to include: (c) labour and all costs and on-costs in connection therewith; (d) materials and goods, and all costs in connection with all other sections handling, conveyance, delivery, unloading, storing, returning, packaging, hoisting and the like; (e) waste of Bidding documentmaterial; and (f) establishment costs, overhead costs and profit. 3.2 The rates quoted by 5.1 ACCESS TO THE SITE Not later than the bidder shall be firm date stated in the relevant Purchase Order Contract, Essential Energy must grant non- exclusive access to the Site to the Contractor and fixed for the completion period Contractor must promptly commence the performance of the tendered worksWorks. The Contractor shall at all times be responsible for: (a) the means and methods of access to and from the Site; and (b) to the extent required to carry out the work under a Purchase Order Contract, obtaining all consents, permits and agreements from all adjoining land owners relating to access and use. The Contractor must comply, and must ensure that its employees, subcontractors and agents comply, with all conditions and restrictions applying to the use or occupation of the Site and any bidder(s) mention adjoining land and the terms performance of any work on the Site. The Contractor warrants that the Purchase Order Price and the Date for Practical Completion make sufficient allowance for the means of accessing and using the Site and land adjoining the Site and the constraints applying to such as “Inclusive” or “Included” access and use and the Contractor shall have no Claim against Essential Energy in respect of Service Tax, their bids will still or in connection with the same. 5.2 CO-ORDINATION The Contractor acknowledges that it is not entitled to possession of the Site and that Essential Energy and others may be evaluated considering carrying out work or performing activities on or about the prices exclusive of Service Tax. However, in Site at the event of such bidder emerging same time as the lowest bidder based on this evaluation, Contractor is carrying out the award shall be made considering work under a Purchase Order Contract and that the service tax included in Contractor will sequence and co-ordinate the quoted rates work under a Purchase Order Contract with the work and the same will be conclusive and binding activities being carried out by any other entity on the bidder.
