The priority of curtailment shall be as specified in the Regulations.

SCHEDULING AND CURTAILMENT. (a) Customer shall submit nominations to NEXUS in accordance with Section 11 of the General Terms and Conditions of the NEXUS FERC Gas Tariff; provided, however, that NEXUS may require Customer to provide nominations on a different schedule in order to ensure timely nominations with, and otherwise to ensure compliance with, Section 5 of the General Terms and Conditions of the Vector Canada Tariff. NEXUS shall not be obligated to deliver a quantity of gas at any delivery point, regardless of any daily nomination by Customer, that exceeds the quantity of gas actually received for Customer’s account at the corresponding nominated receipt point (less any applicable fuel reimbursement quantities). Customer acknowledges that scheduling of all volumes for the Capacity Usage Service shall be subject to and in accordance with Section 7 of the General Terms and Conditions of the Vector Canada Tariff. (b) Customer may request that NEXUS provide the Capacity Usage Service on a segmented basis, and NEXUS shall accommodate any such request to the extent practicable in accordance with the terms of the Vector Canada Tariff. For this Capacity Usage Service, nominations in the aggregate (based on all relevant customer nominations) cannot exceed the MDQ in any segment, or at any point, where the nominated segments overlap. In addition, such segmented service shall not adversely affect system operating conditions. (c) Other than as a result of Force Majeure in accordance with Article VI of this Agreement, NEXUS shall have the right to curtail, interrupt or discontinue service to the extent that service to NEXUS under the NEXUS Vector Canada Agreement is curtailed by Vector Canada, on a pro rata basis among Customer and all other customers based on such customers’ confirmed nominations, subject to the priority of each level of service (including bumping) as set forth in Sections 2.1 and 2.2. (d) Customer agrees that NEXUS shall have no liability for any curtailment of the Capacity Usage Service due to the action or inaction of Vector Canada, regardless of whether the same is in accordance with the Vector Canada Tariff; provided however that Customer shall have the same rights with respect to NEXUS as NEXUS has with respect to Vector Canada for any curtailment pursuant to the Vector Canada Tariff.

  • Scheduling i) The designated employer will provide the employee with their schedule of shifts in accordance with the collective agreement for both homes. [Insert the split/sharing of shift numbers here] Similarly, the employee will submit all requests for time off including vacation to the designated employer in accordance with the collective agreement. ii) Posted schedules will include home identification. An employee will only be scheduled in one home per shift. iii) Overtime payment and other premiums will be in accordance with the collective agreement of the designated employer. iv) Weekends off, consecutive work days and all other scheduling provisions will be in accordance with the collective agreement at the designated employer.

  • Curtailment Any payment of principal on a Mortgage Loan, made by or on behalf of the related Mortgagor, other than a Scheduled Payment, a prepaid Scheduled Payment or a Payoff, which is applied to reduce the outstanding Stated Principal Balance of the Mortgage Loan.

  • Maintenance Scheduling The NTO shall schedule maintenance of its facilities designated as NTO Transmission Facilities Under ISO Operational Control and schedule any outages (other than forced transmission outages) of said transmission system facilities in accordance with outage schedules approved by the ISO. The NTO shall comply with maintenance schedules coordinated by the ISO, pursuant to this Agreement, for NTO Transmission Facilities Under ISO Operational Control. The NTO shall be responsible for providing notification of maintenance schedules to the ISO for NTO Transmission Facilities Requiring ISO Notification. The NTO shall provide notification of maintenance schedules to affected Transmission Owners for NTO Transmission Facilities Requiring ISO Notification and Local Area Transmission Facilities pursuant to Section 3.5.3 of the ISO Services Tariff.

  • Duration of the Processing Personal Data will be Processed for the duration of the Agreement, subject to Section 4 of this DPA.

  • Dispatching 1. Dispatchers will schedule and assign drivers and vehicles in accordance with the trips scheduled for each day; 2. Dispatchers will assist drivers while they are in service to carry out the assigned trips on time by providing address assistance and telephoning passengers as needed. 3. Dispatchers will monitor the performance of scheduled trips, reassigning trips and/or adjusting the number of vehicles in service as needed to ensure on-time performance in the most efficient manner. 4. Dispatchers will provide continuous monitoring of assigned radio frequencies during all hours that vehicles are in service, answer and respond to telephone calls on the Ride Status line, and respond to calls from drivers and OoA staff.
