With the Owner’s approval, the Architect shall adjust the schedule, if necessary, as the Project proceeds until the commencement of construction. § 3.1.4 The Architect shall not be responsible for an Owner’s directive or substitution, or for the Owner’s acceptance of non-conforming Work, made or given without the Architect’s written approval. § 3.1.5 The Architect shall contact governmental authorities required to approve the Construction Documents and entities providing utility services to the Project. The Architect shall respond to applicable design requirements imposed by those authorities and entities. § 3.1.6 The Architect shall assist the Owner in connection with the Owner’s responsibility for filing documents required for the approval of governmental authorities having jurisdiction over the Project.

The Engineer shall provide prompt written notice to Owner if Engineer becomes aware of any error, omission or inconsistency in services or information provided by Owner or Owner’s consultants. § 3.1.2.1 The Engineer’s services shall include the exercise of usual and customary professional care to perform reasonable investigation of the existing conditions, of the accuracy of Owner furnished drawings, and of other information provided by Owner. If materials or equipment tests are required to more accurately determine existing conditions, Engineer will recommend that Owner provide these tests, which recommendation may be accepted or rejected by Owner. If tests are recommended by Engineer and provided at Owner’s expense, Engineer shall be entitled to reasonably rely on their accuracy. SCOPE OF ARCHITECT’S BASIC SERVICES. § 3.1 Architect, prior to signing this Agreement and submitting it to the Owner, shall comply with the provisions of Texas Government Code Section 2252.908, requiring a Disclosure of Interested Parties filed with the Texas Ethics Commission. The Architect’s Basic Services consist of those described in Article 3 and Section 4.1 and include usual and customary architectural services, structural, mechanical, plumbing, and electrical engineering services; landscape design; architectural interior design; audio-visual, data, and telecommunications and technology design and distribution; kitchen and food service equipment design; acoustical engineering and design; site feasibility design; programming for new schools and/or scope of work verification for renovations of existing schools; security planning services; graphics/way-finding planning services; roofing consultant services unless otherwise approved by Owner; accessibility services; estimating by the Architect’s independent estimating consultant; record drawings; professional renderings; design and construction data base management; Texas Commission on Environmental Quality compliance services, if appropriate; and internal auditing and accounting services necessary for Architect to fulfill Architect’s responsibilities under this Agreement and as necessary to complete the Project. Architect shall provide all plans and specifications for all on-site development necessary for the Project, which shall include locating any building on-site, and developing all plans and specifications for site drainage, parking, landscaping, walkways, irrigation, playgrounds, staging areas when appropriate, portable buildings and accompanying infrastructure if applicable. The District will not waive any services recommended by the Architect that are required by law.

The Architect's Basic Services consist of those described in this Agreement and in the Project Work Scope attached as Exhibit A and made a part of this Agreement. Unless otherwise specified on the cover page, the Basic Services include architectural, engineering, consulting, and design services necessary to produce a reasonably complete, coordinated and accurate set of Construction Documents for the Project. The Architect shall review and analyze programs furnished by the Board to ascertain the requirements of any project and shall arrive at a mutual understanding of such requirements with the Board and then commit such understanding to writing and shall furnish a copy of said understanding to the Board for approval before proceeding with preliminary designs. C. The Architect shall act as the Board’s representative/agent in all pertinent phases of design and construction including assisting the Board with all aspects of documents preparation. Any documentation prepared by Architect, shall comply with all applicable laws, statutes, ordinances, codes, orders, rules and regulations in force as of the date of development of the documents. It is understood by Board and Architect that approval by the Board shall be deemed to be approval of the concept but not the means, techniques or methods of construction. D. The Architect will provide other services to the Board in further completing the various projects of the Board. Such other services shall include preparation of documents, preparation of bid documents for projects, limited administration of construction for said projects as may be agreed to between the parties.
