Screening and Confirmation Tests Clause Samples

The "Screening and Confirmation Tests" clause establishes the procedures for conducting initial and follow-up tests to detect the presence of specific substances or conditions, such as drugs or alcohol, in individuals. Typically, this clause outlines when and how screening tests are administered, and specifies that any positive or inconclusive results must be verified through more accurate confirmation tests, often using certified laboratories. Its core practical function is to ensure that test results are reliable and fair, minimizing the risk of false positives and providing a clear process for verifying initial findings.
Screening and Confirmation Tests. The initial test given to an employee is the screening test. If the screening test result is less than 0.02, no further testing will be done. If the result of the screening test is 0.02 or greater, the employee must undergo a second test, the confirmation test. The confirmation test may not be conducted sooner than fifteen (15) minutes after the completion of the screening test. The confirmation test will normally be conducted within thirty (30) minutes after the completion of the screening test, but a confirmation test result is valid even if conducted after thirty (30) minutes. In the event the screening and confirmation tests do not agree, the confirmation test result will be controlling.
