Common use of Second Floor Space Clause in Contracts

Second Floor Space. Landlord and Tenant agree that at the time of the execution of this Lease, the balance of the rentable space on the second (2nd) floor of the Building (“Second Floor Space”) is presently available for leasing. Landlord agrees to notify Tenant on the first occasion that Landlord intends to respond to a request for proposal (or intends to respond to an initial offer from a third party without a prior request for proposal) for all or any part of the Second Floor Space after the date of this Lease. Nothing contained in this Section 32.13 shall be deemed to grant Tenant a right of first refusal or right of first offer for the Second Floor Space, it being the intention of the Landlord and Tenant that the notification under this Section 32.13 is solely for the purpose of affording the Tenant the opportunity to offer to lease additional space on the second floor prior to the next leasing of such space after the execution of this Lease.
