Common use of Section 10.2.1 Clause in Contracts

Section 10.2.1. Employees promoted to a higher rated position or hired into a new general job classification 22 shall be on probationary status for thirty actual days of work. If the District exercised the 23 probation option, employees shall be placed in an existing equivalent position or moved back to 24 the previously held position. Such placement shall be done in consultation with the 25 Association. The probation process shall be grievable only to the extent that the District’s 26 decision is arbitrary and capricious.
