Common use of Section 12.4.1 Clause in Contracts

Section 12.4.1. In the case of an open position created by increasing a position by sixty (60) minutes or more, 23 the position will be filled in accordance with Section 12.5, provided employees may not apply 24 for such position if the move would be a lateral move. If an employee with less hours applies 25 and is selected for a position, the position vacated by that employee will be filled by the 26 employee holding the position that was increased by sixty (60) minutes or more, without 27 further posting.
