Common use of Section 3.1 Clause in Contracts

Section 3.1. 34 It is agreed that all employees subject to this Agreement shall have and shall be protected in the 35 exercise of the right, freely and without fear of penalty or reprisal, to join and assist the Association. 36 The freedom of such employees to assist the Association shall be recognized as extending to 37 participation in the management of the Association, including presentation of the views of the 38 Association to the Board of Directors of the District or any other governmental body, group, or 39 individual. The District shall take whatever action required or refrain from such action in order to 40 assure employees that no interference, restraint, coercion, or discrimination is allowed within the 41 District to encourage or discourage membership in any employee organization. 42 43 Duly elected or appointed members of committees or delegations and all Executive Board members 44 will be allowed a reasonable amount of time to conduct Association business without loss of pay or 45 benefits.

The District shall take whatever 33 action required or refrain from such action in order to 40 assure employees that no interference, restraint, 34 coercion, or discrimination is allowed within the 41 District to encourage or discourage membership in 35 any employee organization. 42 43 Duly elected or appointed members of committees or delegations and all Executive Board members 44 will be allowed a reasonable amount of time to conduct Association business without loss of pay or 45 benefits.

Section 3.1. 34 40 It is agreed that all employees subject to this Agreement shall have and shall be protected in the 35 exercise of the right, right to freely and without fear of penalty or reprisal, to join and assist support 41 the Association; provided, however, that such rights shall not be extended to include strikes, sit-ins, 42 sick-outs, and slow-downs. 36 The freedom of such employees to assist the Association shall be 43 recognized as extending to 37 participation in the management of the Association, including presentation 44 of the views of the 38 Association to the Board of Directors of the District or any other governmental 45 body, group, or 39 individual. The District shall take whatever action required or refrain from such action 46 in order to 40 assure employees that no interference, restraint, coercion, or discrimination is allowed 47 within the 41 District to encourage or discourage membership in any employee organization. 42 43 Duly elected or appointed members of committees or delegations and all Executive Board members 44 will be allowed a reasonable amount of time to conduct Association business without loss of pay or 45 benefits.
