Section 8.7. 34 The employee with the earliest hire date shall have preferential rights regarding shift selection and 35 vacations. The employee with the earliest hire date shall have preferential rights regarding promotions, 36 filling of job assignment vacancies and layoffs when qualifications, ability and/or performance are 37 substantially equal with those individuals junior to them. If the District determines that seniority rights 38 should not govern because a junior employee possesses qualifications, ability and/or performance 39 substantially greater than a senior employee or senior employees, the District shall set forth in writing to 40 the employee or employees its reasons why the senior employee or employees have been bypassed. 41 42 43
