Common use of Secured Leverage Ratio Clause in Contracts

Secured Leverage Ratio. Permit the ratio of Secured Indebtedness to Total Asset Value as at the last day of any period of four consecutive fiscal quarters of the Company to exceed 30%; provided that such ratio may exceed 30% following a Major Acquisition so long as (i) such ratio does not exceed 30% as of the end of more than four (4) consecutive fiscal quarters after such Major Acquisition and (ii) such ratio does not exceed 35% as of any such date of determination.
