Common use of Security Agent instructions Clause in Contracts

Security Agent instructions. For the purposes of Clause 7.2 (Distributions) and Clause 7.6 (Further Assurance - Insolvency Event) the Security Agent shall act: (a) on the instructions of the group of Senior Creditors entitled, at that time, to give instructions under Clause 10.2 (Enforcement Instructions) or Clause 10.3 (Manner of enforcement); or (b) in the absence of any such instructions, as the Security Agent sees fit.

Security Agent instructions. For the purposes of Clause 7.2 (Distributions), Clause 7.5 (Filing of claims) and Clause 7.6 (Further Assurance - assurance – Insolvency Event) the Security Agent shall act: (a) on the instructions of the group of Senior Creditors entitled, at that time, to give instructions under Clause 10.2 (Enforcement Instructions) or Clause 10.3 (Manner of enforcement)an Instructing Group; or (b) in the absence of any such instructions, as the Security Agent sees fitit considers in its discretion to be appropriate.

For the purposes of Clause 7.2 (Distributions), Clause 7.5 (Filing of claims) and Clause 7.6 (Further Assurance - assurance – Insolvency Event) the Security Agent shall act: (a) act on the instructions of the group of Senior Majority External Creditors entitledor, at that time, to give instructions under Clause 10.2 (Enforcement Instructions) or Clause 10.3 (Manner of enforcement); or (b) in the absence of any such instructions, as the Security Agent sees fit.

Security Agent instructions. ‌ For the purposes of Clause 7.2 (Distributions) and Clause 7.6 (Further Assurance - Insolvency Event) the Security Agent shall act: (a) on the instructions of the group of Senior Creditors entitled, at that time, to give instructions under Clause 10.2 (Enforcement Instructions) or Clause 10.3 (Manner of enforcement); or (b) in the absence of any such instructions, as the Security Agent sees fit.

For the purposes of Clause 7.2 8.1 (Distributions), Clause 8.4 (Filing of claims) and Clause 7.6 8.5 (Further Assurance - assurance – Insolvency Event): (a) the Security Agent shall act: (a) act on the instructions of the group of Majority Senior Creditors entitled, at that time(or, to give the extent relating to any Transaction Security or Transaction Security Document, the instructions under Clause 10.2 (Enforcement Instructions) of the Instructing Group in respect of such Transaction Security or Clause 10.3 (Manner of enforcementTransaction Security Document); or (b) in the absence of any such instructions, the Security Agent may act (or refrain from taking action) as the Security Agent sees fit.
