Security Event any unauthorised third-party access to the Services; or
Security Event. If a party learns or has reason to believe that the other party’s Confidential Information has been disclosed or accessed by an unauthorized party (each, a “Security Event”), such party will immediately give notice of such event to the other party to the extent permitted by law or law enforcement authorities. In such notification, the party will report on the nature of the incident, the estimated impact on the other and investigative action taken or planned. Security Events shall include, without limitation, violations of Applicable Law. Notwithstanding anything in this provision, each party will also comply fully with all federal, state or local laws applicable to security breaches. Except as may be required by law or law enforcement authorities, to the extent the breach involves Client Portfolio Information, PFSC will not notify any of Client’s customers or potential customers of unauthorized access of such Security Event without Client’s express consent or upon Client’s specific instruction. The party that experiences the Security Event will be responsible for the costs of any required notifications.
Security Event i. In the event that Subscriber or a Permitted User learns or has reason to believe that any NMLS data, including Public Use Information accessed through NMLS B2B ACCESS℠, has been disclosed or accessed by an unauthorized party as a result of an act or omission of Subscriber or a Permitted User, including by Subscriber’s employees, directors, officers, agents, representatives, independent contractors or any third party engaged by Subscriber (a “Security Event”), Subscriber shall immediately notify SRR and investigate.
ii. In the event of a Security Event that potentially involves individually identifiable information (e.g., social security numbers, driver’s license numbers or dates of birth), Subscriber shall:
I. Notify SRR immediately,
II. After consultation with SRR, notify the individuals whose information was disclosed that a Security Event has occurred, and
III. Be responsible for any other legal obligations, up to $5 million ($5,000,000.00) per Security Event, that may arise under applicable law in connection with such a Security Event.

Security Event. To the extent permitted by applicable law, Blue Yonder shall notify Customer without delay of any actual unauthorized access, use or disclosure of Customer Data (a “Security Event”). If the Security Event was directly caused by Blue Yonder’s failure to meet or exceed the technical and organizational security measures set forth in Section 2(g) above, Blue Yonder shall make commercially reasonable efforts to identify and remediate the cause of such Security Event. Additional information regarding Blue Yonder’s specific obligations in the event of the unauthorized acquisition of personal data is set out in the Data Processing Addendum.
Security Event i. In the event a Permitted User becomes aware of or suspects any NMLS data, including Public Use Information accessed through NMLS B2B ACCESS℠, has been used, disclosed or accessed by an unauthorized party as a result of an act or omission of a Permitted User, including by Subscriber’s employees, directors, officers, agents, representatives, independent contractors or any third party engaged by Subscriber (a “Security Event”), Permitted User shall immediately notify SRR, investigate in coordination with SRR, and keep SRR informed of the status and findings of the investigation.
ii. In the event of a Security Event potentially involving non-public personally identifiable information (“PII”, e.g., social security numbers, driver’s license numbers or dates of birth) that may have been combined with or associated with Public Use Information accessed or used by Subscriber through the Service, Subscriber shall:
a) Notify SRR immediately,
b) Coordinate notification to appropriate State or Federal agency(ies) with SRR,
c) After consultation and in coordination with SRR, notify the individuals whose information was disclosed that a Security Event has occurred, and Be responsible for any other legal obligations arising under applicable law in connection with such a Security Event.
