Common use of Selection of Applications Clause in Contracts

Selection of Applications. The Union and the Employers agree that the referral of Operating Engineers shall be on the following basis: A. Selection of applicants for referral to jobs shall be on a non-discriminatory basis and shall not be based on, or in any way affected by, Union membership, bylaws, rules, regulations, constitutional provisions, or any other aspect of or obligation of Union membership, policies or requirements, or in any way affected by race, color, sex, age or creed. The Union shall dispatch to allow an Employer to comply with State or Federal affirmative action requirements; any other local, State or Federal law; or any reasonable contractual obligation imposed by the owner. B. The Employer retains the right to reject any job applicant referred by the Union for cause but shall not discriminate because of membership or non-membership in the Union or because of race, color, sex, age or creed. C. The Union and the Employer shall post, in places where notices to all Employees and applicants for employment are customarily posted, all provisions relating to the functioning of the hiring provision of this Agreement. D. A.S.A.P. requests from contractors will be based on the member’s geographical proximity to the project location.
