Selection of Subcontractors. 6.3.1 If identified or requested in the District’s Request for Proposal/ Qualifications (“RFP/RFQ”), the Contractor must use any Subcontractors identified and included in the Contractor’s response to the District’s RFP/RFQ pursuant to Education Code section 17406(a)(4). Subcontractors awarded construction subcontracts under this ArticleArticle 6.3.2 shall be afforded all the protections of the Subletting and Subcontracting Fair Practices Act (Chapter 4 (commencing with Section 4100) of Part 1 of Division 2 of the Public Contract Code). 6.3.2.4 All MEP Subcontractors must be prequalified as set forth in Article 1.12 above. 6.3.3 In no case will the Contractor award any subcontracts until the District has concurred to the scope and price of the subcontracted services. 6.3.4 All subcontractors (of any tier) performing any portion of the Work must comply with the Labor Code sections 1725.5 and 1771.1 and must be properly and currently registered with the California Department of Industrial Relations and qualified to perform public works pursuant to Labor Code section 1725.5 throughout the duration of the Project.‌ 6.3.5 Contractor shall provide the District with full documentation regarding the bids or competitive quotes received by Contractor. In no event shall such documentation be redacted or obliterated. In the event the Contractor does not comply with this provision, the District may terminate this Construction Services Agreement in accordance with the provisions of Article 19 below.
