Common use of Service By and Payment to Others Clause in Contracts

Service By and Payment to Others. Any work authorized in writing by City and performed by anyone other than Golf Course Designer or its subcontractors in connection with the proposed Project shall be contracted for and paid for by City directly to the third party or parties. In addition to payments for professional services, this may also include necessary permits, licenses, ownership certifications, materials testing, advertising costs, and other special tests or other work required or requested by City or Golf Course Designer which is not defined within the scope of services of Golf Course Designer. Fees for such extra work shall be subject to negotiation between City and the third party. Fees shall be approved prior to the execution of any extra work. Although Golf Course Designer may assist City in procuring such services of third parties, Golf Course Designer shall in no way be liable to either City or such third parties in any manner whatsoever for such services or for payment thereof.
