Common use of Session Fees Clause in Contracts

Session Fees. Client shall have sole authority to determine and set in real-time Session Fees. Client shall be solely responsible for determining and charging Session Fees in compliance with all applicable laws and regulations (including without limitation any restriction on Client’s use of per-kWh pricing). Client acknowledges that CPI is not responsible for informing Client of applicable laws or changes thereto, and CPI will not be liable to Client or any third party for any alleged or actual failure of Client to comply with such applicable laws and regulations.

Session Fees. Client Customer shall have sole authority to determine and set in real-time Net Session Fees. Client Customer shall be solely responsible for determining and charging Session Fees in compliance with all applicable laws and regulations (including without limitation any restriction on ClientCustomer’s use of per-kWh pricing). Client Customer acknowledges that CPI is not responsible for informing Client Customer of applicable laws or changes thereto, and CPI will not be liable to Client Customer or any third party for any alleged or actual failure of Client Customer to comply with such applicable laws and regulations.
