SETTLEMENT CLASS AND COMMON ISSUES. 3.2.1 The Parties agree that the Proceeding shall be certified as a class proceeding solely for purposes of seeking approval of this Settlement Agreement by the Court. 3.2.2 The Plaintiffs agree that the only proceeding they shall seek to have certified for the purposes of seeking approval of this Settlement Agreement is the Proceeding. 3.2.3 The Plaintiffs agree that, in the Consent Certification Application, the only common issues that they shall seek to have certified are the Common Issues and the only class that they shall seek to have certified is the Settlement Class.
