A Shift Penalty clause establishes additional compensation or penalties for employees who work shifts outside of standard working hours, such as nights, weekends, or public holidays. Typically, this clause specifies the rate or amount of extra pay that applies to these non-standard shifts, ensuring employees are fairly compensated for less desirable or more demanding work times. Its core practical function is to incentivize employees to cover shifts that might otherwise be difficult to staff, while also ensuring fairness and compliance with labor regulations.
Shift Penalty. The annual Shift Penalty is the average weekly Shift Penalty contained in the roster, multiplied by 52 weeks for 7 Day Rosters and 43.6 for all other rosters. The average weekly Shift Penalty is calculated by averaging the shift penalties listed below over a roster cycle and multiplying by the Base Weekly Rate. (b) From 1 March 2023 onwards, where a Doctor works a rostered shift on a Friday that finishes after 6:00pm, the Doctor will be paid a pro-rata allowance proportionate to rostered hours that fall prior to 6:00pm against the full shift length. Example: A Doctor is rostered for an eight (8) hour shift from 2:00pm to 10:00pm on a Friday. The Doctor will receive 50% of the Shift Penalty Payment as four hours of the eight hour shift fall prior to 6:00pm. In addition, the Doctor will receive Friday Night Evening Shift Penalty of 25% for hours worked from 6:00pm until 10:00pm.

Shift Penalty shift penalty is payable to a shift worker under the following circumstances: Category of staff Circumstances under which shift penalty to apply Security officers where the majority of the shift is worked between 4pm and 8am Night cleaners where the shift commences at or after 10pm and before 6am Library, QPS, LETS (Technology support staff) staff where the majority of the hours are worked after 4pm Laboratory assistants (or equivalent) where the majority of the hours are worked after 4pm Parking officers where the shift concludes after 6pm

Shift Penalty. For the purposes of shift work, the following definitions apply:
a. Afternoon shift means any shift finishing after 6.00 pm and at or before midnight
b. Night shift means any specified or rostered shift finishing after midnight and at or before 8.00am.
c. Rostered shift means a shift of which the Employee concerned has had at least 48 hours’ notice.
Shift Penalty. An employee whose shift starts before 7:00am or finishes after 8:00pm shall be paid an allowance as set out in Item 1 of Table 2 per hour or part thereof with a minimum payment as set out in Item 2 of Table 2.
