Common use of Shipment Clause in Contracts

Shipment. Unless expressly agreed to by the Parties in writing, Seller shall select the method of shipment of, and the carrier for, the Goods. Seller may, in its sole discretion, without liability or penalty, make partial shipments of Goods to Buyer. Each shipment will constitute a separate sale, and Buyer shall pay for the units shipped whether such shipment is in whole or partial fulfillment of an Order.

Seller may, in its sole discretion, without liability or penalty, make partial shipments of Goods Products to Buyer; provided, however, all shipments must be made by the Delivery Date. Each shipment will constitute a separate sale, sale and Buyer shall pay for the units shipped Products to be shipped, in accordance with the payment terms specified in Section 5.3, whether such shipment is in whole or partial fulfillment of an a Purchase Order.
