Common use of Simplot Echuca Electricians Availability Agreement Clause in Contracts

Simplot Echuca Electricians Availability Agreement. 47.1 Prior to the commencement of this Agreement, an availability roster arrangement to provide electrician coverage to undertake call backs work out of hour applied at the Echuca site. The terms of this availability roster arrangement will continue to apply on the following modified basis. 47.2 Simplot can determine not to implement the electrician availability arrangement in sub-clause 47.5, subject to providing at least four weeks’ notice to site electricians and their representative that it does not want to continue to implement the terms of this sub-clause. 47.3 If/when the electrician availability arrangement in sub-clause 47.5 is not being implemented, Simplot may still contact electricians out of hours and ask them whether they are prepared to undertake a call back. In such circumstances, it will be voluntary as to whether an electrician agrees to undertake a call back. 47.4 If/when the availability arrangement in sub-clause 47.5 is not being implemented Simplot can decide that it again wants to implement this sub-clause. Before doing so, Simplot will notify and consult with the employees and their representative concerning the arrangements for again implementing this Agreement provision. In such circumstances, it will be purely voluntary as to whether individual electricians put themselves down on the roster to provide this call back availability coverage. 47.5 In accordance with sub-clauses 47.1 to 47.4 (inclusive), electricians will establish and implement an availability roster that operates on the following basis to provide coverage to undertake out of hours work: a. Individual employees can choose whether they wish to participate in the roster; b. Rostered employees on an availability roster will be expected to undertake call- backs as required; c. Being listed on the roster and receiving the payment of the availability allowance does not require employees to hold themselves in readiness after ordinary hours or work (i.e. the employees on this roster are not on standby); d. Employees on the availability roster and receiving the allowance for that week will be given the first opportunity to undertake call backs; e. If the employee who is listed as available is unable to undertake the call back, then that employee must arrange for another employee to undertake the call back; f. A weekly allowance of $196.33 will be paid from the first pay period on and after 1 April 2021 to the employee who is on the availability roster for that week. A week shall be defined as a seven day period that coincides with the weekly plan; g. The availability allowance is not part of any all-purpose rate and is not payable for superannuation, annual leave, personal leave or long service leave purposes; h. The availability allowance may be shared between individual employees on the roster and will increase as follows: i. $201.24 per week from the first pay period on and after 1st April 2022; ii. $206.27 per week from the first pay period on and after 1st April 2023; i. The availability allowance will increase regardless of whether or not the availability roster arrangement is being implemented at the time the increases become applicable; j. The weekly plan will show the name of the employee that is available for that week; k. Payments for call backs undertaken will be as per the Agreement. Seasonal employees may be stood down:  on 4 working hours' notice, or  by notification 14 hours before being due to commencing their next shift.

In such circumstances, it will be voluntary as to whether an electrician agrees to undertake a call back. 47.4 48.4 If/when the availability arrangement in sub-clause 47.5 48.5 is not being implemented Simplot can decide that it again wants to implement this sub-clause. Before doing so, Simplot will notify and consult with the employees and their representative concerning the arrangements for again implementing this Agreement provision. The availability allowance may be shared between individual employees on the roster and will increase as follows: i. $201.24 187.78 per week from the first pay period on and after 1st April 20222019; ii. $206.27 192.48 per week from the first pay period on and after 1st April 20232020; i. The availability allowance will increase regardless of whether or not the availability roster arrangement is being implemented at the time the increases become applicable; j. The weekly plan will show the name of the employee that is available for that week; k. Payments for call backs undertaken will be as per the Agreement. Seasonal employees may be stood down:  down on 4 working hours' notice, or  by notification be notified 14 hours before being due to commencing their next shift.
