Common use of Simultaneous Adjustments Clause in Contracts

Simultaneous Adjustments. In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4), 11.07 or 11.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.06, second, the provisions of Section 11.08 and, third, the provisions of Section 11.07.

Simultaneous Adjustments. In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4)11.06, 11.07 or 11.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.06, second, the provisions of Section 11.08 and, third, the provisions of Section 11.07.

Simultaneous Adjustments. In the event that this Article 11 X requires adjustments to the Conversion Rate under more than one of Sections 11.06(410.6(4), 11.07 10.7 or 11.0810.8, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.6, second, the provisions of Section 11.08 10.8 and, third, the provisions of Section 11.0710.7.

In the event that this Article 11 10 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4)10.06, 11.07 10.07 or 11.0810.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.06, second, the provisions of Section 11.08 10.08 and, third, the provisions of Section 11.0710.07.

Simultaneous Adjustments. In the event that this Article 11 Eleven requires adjustments to the Conversion Rate conversion price or conversion rate under more than one of Sections 11.06(411.07(4), 11.07 11.08 or 11.0811.09, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0611.07, second, the provisions of Section 11.08 11.09 and, third, the provisions of Section 11.0711.08.

Simultaneous Adjustments. In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4)11.06, 11.07 or 11.0811.08 hereof, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0611.06 hereof, second, the provisions of Section 11.08 hereof and, third, the provisions of Section 11.0711.07 hereof.

Simultaneous Adjustments. In the event that this Article 11 Eleven requires adjustments to the Conversion Rate conversion price or conversion rate under more than one of Sections 11.06(411.07(4), 11.07 11.08 or 11.0811.09, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0611.07, second, the provisions of Section 11.08 11.09 and, third, the provisions of Section 11.07.11.08. 43

In the event that this Article 11 10 requires adjustments to the Conversion Rate under more than one of Sections 11.06(410.06(4), 11.07 10.07 or 11.0810.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, applying first, the provisions of Section 11.0610.06, second, the provisions of Section 11.08 and, 10.08 and third, the provisions of Section 11.0710.07.

In the event that this Article 11 Ten requires adjustments to the Conversion Rate conversion price or conversion rate under more than one of Sections 11.06(410.07(4), 11.07 10.08 or 11.0810.09, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.07, second, the provisions of Section 11.08 10.09 and, third, the provisions of Section 11.07.10.08. 55

In the event that this Article 11 10 requires adjustments to the Conversion Rate under more than one of Sections 11.06(410.6(4), 11.07 10.7 or 11.0810.8, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.6, second, the provisions of Section 11.08 10.8 and, third, the provisions of Section 11.0710.7.

In the event that this Article 11 12 requires adjustments to the Conversion Rate under more than one clause of Sections 11.06(4), 11.07 or 11.08Section 12.06, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.06clause (a), second, the provisions of Section 11.08 clause (c) and, third, the provisions of Section 11.07clause (b).

Simultaneous Adjustments. In the event that this ------------------------ Article 11 10 requires adjustments to the Conversion Rate under more than one of Sections 11.06(410.6(4), 11.07 10.7 or 11.0810.8, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.6, second, the provisions of Section 11.08 10.8 and, third, the provisions of Section 11.0710.7.

In the event that this Article 11 Ten requires adjustments to the Conversion Rate conversion price or conversion rate under more than one of Sections 11.06(410.07(4), 11.07 10.08 or 11.0810.09, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.07, second, the provisions of Section 11.08 10.09 and, third, the provisions of Section 11.0710.08.

In the event that this Article 11 requires adjustments to the Conversion Rate (or Conversion Price) under more than one of Sections 11.06(4)11.06, 11.07 or 11.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.06, second, the provisions of Section 11.08 and, third, the provisions of Section 11.07.

Simultaneous Adjustments. In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.06(411.06(d), 11.07 11.07, 11.08 or 11.0811.09, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.06, second, the provisions of Section 11.08 and, third, the provisions of Section 11.09, and, fourth, the provisions of Section 11.07.

Simultaneous Adjustments. In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4), 11.07 or 11.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.06, second, the provisions of Section 11.08 and, third, the provisions of Section 11.07. 73 Section 11.18.

Simultaneous Adjustments. In the event that this Article 11 7 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4Section 7.6(4), 11.07 7.7 or 11.087.8, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments adjustment shall be made by applying, first, the provisions of Section 11.067.6, second, the provisions of Section 11.08 7.8 and, third, the provisions of Section 11.077.7.

Simultaneous Adjustments. In the event that this Article 11 Ten requires adjustments to the Conversion Rate conversion price or conversion rate under more than one of Sections 11.06(410.07(4), 11.07 10.08 or 11.0810.09, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.07, second, the provisions of Section 11.08 10.09 and, third, the provisions of Section 11.07.10.08. 54

Simultaneous Adjustments. In the event that this Article 11 12 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4)Section 12.6, 11.07 Section 12.7 or 11.08Section 12.8 hereof, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0612.6 hereof, second, the provisions of Section 11.08 12.8 hereof and, third, the provisions of Section 11.0712.7 hereof.

Simultaneous Adjustments. In the event that If this Article 11 10 requires adjustments to the Conversion Rate under more than one of Sections 11.06(410.06(4), 11.07 10.07, 10.08 or 11.0810.09, and the record dates or the dates of announcement for the distributions or issuances giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.06, second, the provisions of Section 11.08 and10.08, third, the provisions of Section 11.0710.07 and, fourth, the provisions of Section 10.09.

Simultaneous Adjustments. In the event that this Article 11 ------------------------ Seven requires adjustments to the Conversion Rate under more than one of Sections 11.06(4)7.6, 11.07 7.7 or 11.087.8, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.067.6, second, the provisions of Section 11.08 7.8 and, third, the provisions of Section 11.077.7.

Simultaneous Adjustments. In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.06(411.07(4), 11.07 11.08, 11.09 or 11.0811.10, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0611.07, second, the provisions of Section 11.08 and11.09, third, the provisions of Section 11.0711.10 and, fourth, the provisions of 11.08.

In the event that this Article 11 X ----------------------------------------- requires adjustments to the Conversion Rate under more than one of Sections 11.06(410.6(4), 11.07 10.7 or 11.0810.8, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.6, second, the provisions of Section 11.08 10.8 and, third, the provisions of Section 11.0710.7.

In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.06(411.06(d), 11.07 or 11.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.06, second, the provisions of Section 11.08 and, third, the provisions of Section 11.07.

In the event that If this Article 11 10 requires ------------------------ adjustments to the Conversion Rate under more than one of Sections 11.06(410.06(4), 11.07 10.07 or 11.0810.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.06, second, the provisions of Section 11.08 10.08 and, third, the provisions of Section 11.0710.07.

In the event that If this Article 11 Twelve requires adjustments to the Conversion Rate under more than one of Sections 11.06(4Section 1206(4), 11.07 1207 or 11.081208, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.061206, second, the provisions of Section 11.08 1208 and, third, the provisions of Section 11.071207.

Simultaneous Adjustments. In the event that this Article 11 7 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4Section 7.6(4), 11.07 7.7 or 11.087.8, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.067.6, second, the provisions of Section 11.08 7.8 and, third, the provisions of Section 11.077.7.

Simultaneous Adjustments. In the event that this Article 11 X requires adjustments to the Conversion Rate under more than one of Sections 11.06(410.06(iv), 11.07 10.07 or 11.0810.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0610.06, second, the provisions of Section 11.08 10.08 and, third, the provisions of Section 11.0710.07.

Simultaneous Adjustments. In the event that this Article 11 9 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4)9.06, 11.07 9.07, 9.08, or 11.089.09, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.069.06, second, the provisions of Section 11.08 and9.08, third, the provisions of Section 11.079.09 and, fourth, the provisions of Section 9.07.

Simultaneous Adjustments. In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.06(4), 11.07 or 11.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.06, second, the provisions of Section 11.08 and, third, the provisions of Section 11.07.. 61 68

Simultaneous Adjustments. In the event that this Article 11 IX requires adjustments to the Conversion Rate under more than one of Sections 11.06(49.06(4), 11.07 9.07 or 11.089.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.069.06, second, the provisions of Section 11.08 9.08 and, third, the provisions of Section 11.079.07.

Simultaneous Adjustments. In the event that this Article 11 13 requires adjustments to the Conversion Rate under more than one of Sections 11.06(413.06(4), 11.07 13.07 or 11.0813.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.0613.06, second, the provisions of Section 11.08 13.08 and, third, the provisions of Section 11.0713.07.
