Site Visits and Reports. i. The Architect and its Consultants, as representatives of the Owner, shall visit the site at intervals appropriate to the stage of the Contractor’s operations, progress, and completion efforts, or as otherwise agreed by the Owner and Architect to: (1) become generally familiar with and to keep the Owner informed about the progress and quality of the portion of the Work completed; (2) endeavor to guard the Owner against defects and deficiencies in the Work; and (3) determine in general if the Work is being performed in a manner indicating that the Work, when fully completed, will be in accordance with the Contract Documents. The Architect shall carefully review the quality and quantity of the Work at least on a monthly basis as part of the Architect’s Basic Services and shall identify Work not in conformance with the Construction Documents. The Architect shall report to the Owner, in writing, known deviations from the Contract Documents and from the most recent construction schedule submitted by the Contractor. ii. Neither the professional activities of the Architect, nor the presence of its employees and Consultants at the construction site, shall relieve the General Contractor and any other entity of their obligations, duties, and responsibilities including but not limited to, construction means, methods, sequence, techniques or procedures necessary for performing, superintending or coordinating all portions of the Work of construction in accordance with the contract documents and any health or safety precautions required by any regulatory agencies. The Architect and its personnel have no authority to exercise any control over any Contractor and/or their subcontractor(s) or any other entity or their employees in connection with their work or any health or safety precautions. The Owner agrees that the General Contractor is solely responsible for jobsite safety, and warrants that this intent shall be made evident in the Owner’s agreement with the General Contractor. The Owner also agrees that the Owner, the Owner’s Representative, Architect, and the Architect’s Consultants shall be indemnified and shall be made additional insureds under the General Contractor’s general liability insurance policy. iii. The Architect shall have authority to recommend in writing that the Owner reject Work that does not conform to the Contract Documents. Whenever the Architect considers it necessary or advisable for implementation of the intent of the Contract Documents, the Architect shall have authority to recommend in writing that Owner require additional inspection and/or testing of the Work in accordance with the provisions of the Contract Documents, whether or not such Work is fabricated, installed or completed.
