Common use of Small Business Unlimited Usage Definition Clause in Contracts

Small Business Unlimited Usage Definition. Momentum’s definition of “unlimited usage” is based on the combined number of inbound and outbound voice minutes and fax pages (excluding all Momentum advertising and informational messages). We reserve the right to at any time enforce this policy in accordance with its terms. If the average voice usage exceeds 3,000 minutes per extension or over 500 fax pages within any thirty day period, such usage shall be deemed excessive. In that event, you agree to pay a per minute or per page surcharge, which is currently $0.03 per minute and/or $0.03 per fax page. This overage fee applies to all plans including the unlimited plans. Alternatively, in the sole discretion of Momentum, your Service may be immediately terminated.
