Common use of Smart NID Clause in Contracts

Smart NID. Windstream does not currently deploy “smart” NIDs, and prior to Carrier’s use of any “smart” NID Windstream may deploy in the future, the Parties must first agree to a price. To the extent Windstream deploys “smart” devices in the future, in general meaning a terminating device that permits the service provider to isolate the Loop facility from the premises wiring for testing purposes, and such devices have spare functioning capacity not currently used by Windstream or any other provider, Windstream shall provide unbundled access to such devices. Windstream shall also continue to allow Dialog Telecommunications, at its option, to use all features and functionality of the Windstream NID including any protection mechanisms, test capabilities, or any other capabilities now existing or as they may exist in the future regardless of whether or not Dialog Telecommunications terminates its own distribution facility on the NID.
