Common use of SNDAs Clause in Contracts

SNDAs. Upon the request of Buyer, Seller shall request, at no material cost or expense to Seller, the tenants execute a subordination and non-disturbance agreement in the form requested by Buyer (an “SNDA”) and Seller shall deliver to Buyer any executed SNDA upon receipt of same. Seller’s failure to obtain an SNDA from the tenants shall not constitute a default by Seller hereunder or be a condition precedent to Closing.

SNDAs. Upon Seller agrees that upon the request of Buyer, Seller shall requestuse commercially reasonable efforts to deliver to tenants of the Property the form of subordination, at no material cost or expense to Seller, the tenants execute a subordination and non-disturbance and attornment agreement in required by Buyer’s lender (if any) (“SNDAs”), provided that Buyer fully prepares each SNDA for such delivery, and shall request that such tenants execute and return the form requested by Buyer (an “SNDA”) and SNDAs prior to Closing; provided, however, that it shall not be a condition to Closing that Seller shall deliver to Buyer any the executed SNDA upon receipt of same. SNDAs and Seller’s failure to obtain an SNDA from deliver the tenants executed SNDAs to Buyer shall not constitute a default by Seller hereunder or be a condition precedent to Closingunder this Agreement.

SNDAs and Seller’s failure to obtain an SNDA from deliver the tenants executed SNDAs to Buyer shall not constitute a default by Seller hereunder or be a condition precedent to Closingunder this Agreement.
