Common use of Source and Quantity ICM Clause in Contracts

Source and Quantity ICM. The ICM approved for placement under this Agreement shall come only from the Originating Location of ICM as identified in Section A of Schedule “B”. Prior to the Authority agreeing to accept ICM from the Originating Location, Generator must complete Schedule “B” to this Agreement and submit it to the Authority. Schedule “B” contains information concerning the Originating Location of the ICM, including but not limited to the history of use of the property and surrounding properties, the estimated quantity of ICM as well as the information required in Article 2.04 (Sampling Schedule). This information will be reviewed by the Authority to determine whether other testing is appropriate, prior to acceptance of ICM by the Authority from the Originating Location. Further, Generator, by proposing to deliver ICM to the Facility from such Originating Location, makes representation and asserts as fact to the Authority that he / she is legally entitled to remove the subject ICM from that source location by virtue and authority of other such agreements as are beyond the Authority’s knowledge.
