Special Allowances. (a) A registered nurse in charge during the day, evening or night of a hospital having a daily average of occupied beds of less than 100 shall be paid, in addition to her or his appropriate salary, whilst so in charge, the sum set out in Table 2 - Other Rates and Allowances, of Part B Monetary Rates, per shift. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.
(d) Where an employee on call leaves the hospital and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances the allowance payable shall be the rate set out in Table 2. The provisions of this paragraph shall apply to all employees.
(e) This subclause shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursing.

(a) An Employee required by his or her Employer to be on call otherwise than as provided in (ii)(b) and (ii)(c) hereof shall be paid the sum as set in Item 4 of Table 2 for each hour or part thereof with a minimum payment of eight hours at that rate.
(b) An Employee required to be on call on rostered days off shall be paid the sum as set in Item 5 of Table 2 for each hour or part thereof with a minimum payment of eight hours at that rate.
(c) The parties recognise the importance of Employees being afforded the opportunity to take a meal break, noting however that where an Employee is required and authorised by the Employer to remain on call during a meal break, such Employee shall be paid an allowance as set out in Item No 6 of Table 2.
(d) Where an Employee on call leaves the hospital and is recalled to duty, the Employee shall be reimbursed all reasonable fares and expenses actually incurred provided that where an Employee uses a motor car in these circumstances the allowance payable shall be the rate set out in Item 13 of table

(e) This subclause shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director Assistant Directors of Nursing or Grade 2 provided that the allowances prescribed in subclauses (a) and (b) of this subclause shall be paid to Assistant Director Directors of NursingNursing Grade 2 when required to remain on call for the purpose of the performance of clinical duties.
(aii) An employee required to wear a lead apron shall be paid an allowance as set out in Item 7, of Table 2 of Part B for each hour or part thereof that they are required to wear the said apron.
(iii) A registered nurse who is designated to be in charge of a ▇▇▇▇ or unit during day, evening or night shifts, when the Nursing Unit Manager is not rostered for duty, shall be paid an allowance as set out in Item 8, of Table 2 of Part B per shift. Provided that the allowance shall also be paid when the Nursing Unit Manager is rostered on duty if the day to day clinical management role for the shift is delegated to a designated registered nurse. Provided further that the allowance shall also be paid in the absence of a Nurse Manager in facilities where the Nurse Manager undertakes the functions usually carried out by a Nursing Unit Manager.
(iv) A registered nurse who is designated to be in-charge of a ▇▇▇▇ or unit when the Nursing Unit Manager is not rostered for duty and who is also designated to be in-charge of a the hospital with (if less than 100 beds a hundred beds) during the day, evening or night on the same shift shall be paid an allowance per shift of the sum as set out in Item 9, of Table 2-Other Rates & Allowances2 of Part B per shift. This subclause Provided that this allowance shall only apply also be paid in facilities where the registered nurse is Nurse Manager undertakes the functions usually carried out by a Nursing Unit Manager.
(a) An employee who makes their services available and participates in charge an approved roster to provide emergency telephone counselling outside their normal rostered ordinary hours shall receive the payments prescribed in paragraphs (b), (c) and (d) of one or more other nurses in the ▇▇▇▇ or unit in questionthis subclause.
(b) An employee rostered to be on call shall be paid the sum as set in Item 2 of Table 2 of Part B for each hour or part thereof with a minimum payment of eight hours at that rate. Provided that an employee rostered on call on rostered days off shall be paid the sum as set in Item 3, of Table 2 of Part B for each hour or part thereof with a minimum payment of eight hours at that rate.
(c) If during such an on call period prescribed in paragraph (b) of this subclause an employee is required to provide telephone counselling to a client, such employee shall be entitled to the following payment in addition to the payment in the said paragraph (b):
(1) An employee on call for telephone counselling for up to 8 hours and is required to provide telephone counselling, such employee is to be paid one hour at ordinary rates (excluding penalties). If an employee receives more than one call to provide telephone counselling, no additional payment is to be made.
(2) An employee on call for telephone counselling for 8-16 hours and is required to provide telephone counseling, such employee is to be paid two hours at ordinary rates (excluding penalties). If an employee receives more than one call to provide telephone counselling, no additional payment is to be made.
(3) An employee on call for telephone counselling for 16-24 hours and is required to provide telephone counseling, such employee is to be paid three hours at ordinary rates (excluding penalties). If an employee receives more than one call to provide telephone counselling, no additional payment is to be made.
(d) An employee called out during the period of on call shall be entitled to the prescriptions of clause 16, Overtime.
(vi) An Enrolled Nurse employed in the central sterile supply department of the hospital, in possession of a Sterilising Technology Certificate issued by the Sterilising Research and Advisory Council of Australia shall be paid an allowance as set out in Item 17 of Table 2 of Part B.
(vii) A Registered Nurse who is designated in-charge of the hospital during an evening or night shift Monday to Friday or any Saturday or Sunday shift shall be paid an allowance per shift as set out in Item 9 (b), of Table 2 of Part B. This subclause allowance shall not apply to registered nurses holding classified positions of a higher grade than Clinical Nurse Specialist Grade 2. The employer shall not use this provision on a permanent basis in place of appointing a registered nurse Nurse Manager.

(c) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum as set out in Item 4, of Table 2 provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.Part B.
(d) Where an employee on call leaves the public hospital and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances circumstances, the allowance payable shall be the rate set out in Table 2prescribed from time to time by the Ministry for a "casual" user. The provisions of this paragraph shall apply to all employees.
(e) This subclause shall not apply to Nurse Managers classified at Grade 4 or above provided that the allowances prescribed in subclauses (a) and (b) of this subclause shall be paid to Nurse Managers classified at Grade 4, Grade 5 and Grade 6 when required to remain on call for the purpose of the performance of clinical duties.
(iii) (a) Where a Director of Nursing, Subsidiary Nursing is required by the Public Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursing.

(ed) This subclause clause shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursingall classifications covered by this agreement.
(aiii) A registered nurse who is designated to The allowances prescribed by this Clause will be in-charge of a ▇▇▇▇ or unit when the Nursing Unit Manager is not rostered for duty and who is also designated to be in-charge of a hospital adjusted in line with less than 100 beds during the day, evening or night on the same shift shall be paid an allowance per shift of the sum set out in Table 2-Other Rates & Allowances. 15.2 On Call
(a) An employee required by their his or her employer to be on call otherwise than as provided for in paragraph (b) shall be paid the sum amount set out in Table 2 3 of Schedule 1 – Wages and Allowances for each designated on-call period or part thereof. A designated on-call period may be for a period of 24 twenty-four (24) hours or part thereof provided that only one allowance shall be payable in any period of 24 twelve (12) hours.
(b) An employee required to be on call on rostered days off in accordance with subclause 6.15(b) of Clause 623.15, Hours of Work and Free Time of Employees other than Other Than Directors of Nursing, Nursing of the Agreement shall be paid the sum amount set out in Table 2 3 of Schedule 1 – Wages and Allowances for each designated on call period of 24 hours or part thereof provided that only one allowance shall be payable in any period of 24 hours.designated on call period..
(c) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in Table 2 provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a) above. 15.3 An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in Table 3 – Other Allowances and Rates provided that no allowance shall be paid if, during a period of twenty four (24) hours including such period of on call, the employee is entitled to receive the allowance prescribed in (a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.
15.4 An employee required to wear a lead apron shall be paid an allowance of the sum set out in Table 3 for each hour or part thereof that they are required to wear the said apron.
15.5 In the event that the hospital’s daily average of occupied beds is reduced to less than 100, the following additional allowances shall be paid:
(a) A registered nurse in charge during the day, evening or night of the hospital, shall be paid, in addition to her or his appropriate salary, whilst so in charge, the sum set out in Table 3 - Other Rates and Allowances, of Schedule 1 – Wages and Allowances, per shift.
(e) This subclause shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursing.
(ab) A registered nurse who is designated to be in-charge of a ▇▇▇▇ or unit when the Nursing Unit Manager is not rostered for duty and who is also designated to be in-charge of a the hospital with less than 100 beds during the day, evening or night on the same shift shall be paid an allowance per shift of the sum set out in Table 2-3 – Other Rates & and Allowances. This subclause shall only apply where the registered nurse is in charge of one or more other nurses in the ▇▇▇▇ or unit in question.
(bc) This subclause shall not apply to registered nurses holding classified positions of a higher grade than of a registered nurse nurse.
15.6 The allowances prescribed by this Clause will be adjusted in line with all future increases in the Rates of Pay prescribed by this Agreement.

(c) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in Item 5 of Table 2 provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.
(d) Where an employee on call leaves the hospital and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances the allowance payable shall be the rate set out in Item 8 of Table 2. The provisions of this paragraph shall apply to all employees.
(e) This subclause shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursing.
12.3 An employee required to wear a lead apron shall be paid an allowance of the sum set out in Item 6 of Table 2 for each hour or part thereof that they are required to wear the said apron.
(a) A registered nurse Registered nurses who is prior to the commencement of this Agreement were receiving $40.72 when designated to be in-charge of a ▇▇▇▇ or unit when the Nursing Unit Manager is not rostered for duty and who is also designated to be in-charge of a hospital with less than 100 beds during the day, evening or night on the same shift shall continue to be paid an $40.72 on all future occasions on which they are designated as such until such time as the In Charge of ▇▇▇▇/Unit and Hospital Allowance in Table 2 exceeds this amount. When the In Charge of ▇▇▇▇/Unit and Hospital Allowance at item 7 in Table 2 exceeds $40.72 all nurses who qualify for the allowance will be paid the amount in Table 2.
(b) Registered nurses who after the commencement of this Agreement are for the first time designated to be in-charge of a ▇▇▇▇ or unit in accordance with the preceding subclause shall be paid the allowance per shift of the sum as set out in Item 7 of Table 2-Other Rates & Allowances. (c) The preceding two subclauses only apply where the registered nurse is in charge of one or more other nurses in the ▇▇▇▇ or unit in question.

12.14.1 shall be paid the sum set out in Table 2 Schedule 2: Allowances for each period of 24 hours or part thereof with a minimum payment of eight hours at that rate provided that only one allowance shall be payable in any period of 24 hours.
(c) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in Table 2 Schedule 2: Allowances provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a(a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.
(d) Where an employee on call leaves the hospital and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances the allowance payable shall be the transport rate set out in Table 2prescribed from time to time by the NSW Health Department. The provisions of this paragraph shall apply to all employees.
(e) This subclause shall not apply to a Director all classifications up to and inclusive of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursingthe Nurse Unit Manager classifications.

(c) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in Item 11, Table 2 - Other Rates & Allowances provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.
(d) Where an employee on call leaves the hospital Facility and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances the allowance payable shall be the rate set out in Item 12, Table 22 - Other Rates & Allowances. The provisions of this paragraph shall apply to all employees.
(e) Where an employee is called upon and agrees to use his or her own private vehicle for official business, payment of an allowance shall be made by utilising the rate per kilometre in Item 12 of Table 2. This subclause shall apply to all employees.
(f) Subclause 12.2 shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Deputy Director of Nursing.
(a) A registered nurse Employees who is designated are required to be in-charge drive a vehicle as part of a ▇▇▇▇ their normal duties (excluding ambulance, bus or unit when the Nursing Unit Manager is not rostered for duty and who is also designated to be in-charge of a hospital with less than 100 beds during the dayother motor vehicle drivers), evening or night on the same shift shall be paid an allowance per shift of the sum amount per week as set out in Item 13 of Table 2-2 - Other Rates & and Allowances. This subclause shall only apply where the registered nurse is , of Part B, in charge of one or more other nurses addition to their ordinary salary for each week in the ▇▇▇▇ or unit in questionwhich they are required to drive a vehicle.
(bi) Provided that, an employee required to drive more than 10 hours in any week shall be paid the appropriate rate for a motor vehicle driver for the time spent driving with a minimum payment per week of the amount set out in the said Item 14.
(ii) An employee who drives a vehicle for more than 4 hours in any one day or shift, shall be paid as a motor vehicle driver for that day or shift, with a minimum payment as set out in Item 15.
(iii) An employee required to drive for more than 20 hours in any week shall be paid as motor vehicle driver for that week.
(iv) This subclause shall not apply to registered nurses holding classified positions any employee in receipt of a salary in excess of that prescribed in this award for a motor vehicle driver, and this subclause shall not apply to any employee who is required to relieve the driver of any motor vehicle and who is entitled to be paid in accordance with clause 17, Higher Duties.
(b) An employee defined in clause 5.4 of this Agreement, who in addition to their ordinary duties is appointed as a Leading Hand in charge of not less than two other employees, shall be paid an allowance as part of salary as set out in Items 16 to 19 of Table 2 - Other Rates and Allowances, of Part B. This loading is not paid to an employee appointed to supervise other staff who is in receipt of a higher grade than wage rate for the additional responsibility required.
(a) The Director of Nursing shall be paid the appropriate sum as set out in Item 20 of Table 2 - Other Rates and Allowances, of Part B, Monetary Rates.
(b) Payment equal to one quarter of the annual amount is to be made at the end of each three month period subsequent to appointment as Director of Nursing.
(c) The allowance in paragraph (a) of this clause is not payable where the Director of Nursing is being remunerated at a registered nurse rate of 1% or more above the base rate for a Director of Nursing set out in Table 1 of Part 2 of this award.

(a) An employee required by ▇▇▇▇▇▇▇▇▇▇ Heart Clinic to be on call:
(i) otherwise than as provided for in subclauses 13.2(a)(ii) to 13.2(a)(v), shall be paid the sum set out in Item 4 of Table 2 (Part B) for each period of 24 hours or part thereof provided that only one allowance shall be payable in any period of 24 hours; or
(ii) on a rostered day off, shall be paid the sum set out in Item 5 of Table 2 (Part B) of this Agreement for each period of 24 hours or part thereof provided that only one allowance shall be payable in any period of 24 hours; or
(iii) from 6pm Friday to 8am Saturday, shall be paid the sum set out in item 6 of Table 2 (Part B) of this Agreement; or
(iv) for the 24 period commencing from 8am Saturday or from 8am Sunday, shall be paid the sum set out in item 7 of Table 2 (Part B) of this Agreement; or
(v) on a public holiday, shall be paid the sum set out in item 8 of Table 2 (Part B) of this Agreement.
(b) Where an employee on call leaves the hospital and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances the allowance payable shall be the rate set out in Item 9 of Table 2 (Part B). The provisions of this subclause, 13.2(c), shall apply to all employees.
(c) This subclause shall not apply to a Director of Nursing, or a Deputy Director of Nursing.
13.3 An employee required to wear a lead apron shall be paid an allowance of the sum set out in Item 10 of Table 2 (Part B) for each hour or part thereof that they are required to wear the said apron.
13.4 A Registered Nurse designated as Nurse Clinician on shift shall be paid the allowance set out in Item 11 of Table 2 – Other Rates and Allowances each shift they are so designated. Duties of a registered nurse Nurse Clinician may include preparing patients for their procedure and ensuring medical files are prepared for lists the following day. This may involve gathering referral letters and operation reports etc.
13.5 A Registered Nurse designated as Team Leader on shift shall be paid the allowance set out in Item 12 of Table 2 – Other Rates and Allowances each shift they are so designated. Responsibilities of a Team Leader include coordinating the lists each day, liaising with consultant wards, allocating staff and general problem solving.

(bd) This With the exception of registered nurses who have been appointed as a Clinical Nurse/Midwifery Specialist, this subclause shall not apply to registered nurses holding classified positions of a higher grade than that of registered nurse.
11.2. On-call and recall
(a) Employees may be required to remain on-call.
(b) The employee will ensure that they are easily contactable during the hours for which they have been placed on-call and may be required to remain within an agreed access period of the workplace as specified within department policy. For the avoidance of doubt, the terms of the relevant department policy are not incorporated into this Agreement.
(c) Should an Employee not reside within the prescribed access period the Employer will provide onsite accommodation at no charge to the Employee.
(d) Where an Employee is required to remain on-call they will be paid an on-call allowance per period of 24 hours or part thereof - see allowances table.
(e) Where an Employee is required to remain on-call and they are not recalled to work the time spent on-call will not count as hours worked.
(f) Where an Employee is required to remain on-call and is recalled to the workplace to perform work the overtime provisions will apply. Further, they will be paid for a registered nurse minimum of 4 hours work at the appropriate overtime rate in addition to the on-call allowance - see allowances table.
(g) The recall period for which the Employee is paid will commence when the Employee arrived at the workplace.
(h) An Employee who is required to remain on–call and who is recalled by the Employer to perform work where such work can be managed without the Employee returning to the workplace (e.g. by telephone or remote computer access or other electronic communication) will be paid for a minimum of one hour at the appropriate overtime rate set out in clause 17.4 for such recall work (i.e. one hour plus the applicable overtime penalty):
(1) Multiple recall requests made and concluded within the same hour will be compensated within the same one hour’s overtime payment. For subsequent recall requests made and concluded beyond the first hour, a further minimum payment of one hour at the appropriate overtime will apply, provided that multiple recall requests made and concluded within a discrete 60-minute period will not attract additional payment.
(2) The arrangements set out in subclause 17.11 regarding time off in lieu of payment of overtime will apply. For the avoidance of doubt, subclause 17.5 does not apply to recall work performed away from the workplace.
(i) Employees will not be required to remain on-call whilst on leave (paid or unpaid) or on the day before their leave period begins.
(j) The Employer will endeavour not to require an Employee to remain on-call on an accrued day off (ADO) or on the day before an ADO. Where it is necessary to ensure continuity of services, the Employee shall be paid a relevant on-call allowance – see allowance table.
(k) Where an Employee is required to remain on-call during a meal break they will be paid an on-call allowance – see allowance table.
(l) An Employee recalled to work will be provided with transport to and from their home or refunded the cost of the transport.
(m) Where an Employee has completed one period of work on-call and returns home and then is recalled in to the workplace again during the same 24 hour period of on–call then the second and subsequent periods of recall work time will be added to the first period of recall work when calculating overtime payments.
11.3. Lead apron allowance An Employee required to wear a lead apron shall be paid an allowance of the sum set out in Item 10 of Table 2 (Part B) for each hour or part thereof that they are required to wear the said apron.
11.4. Continuing education allowance
(a) An Employee employed in the classification of Registered Nurse/Midwife years 1- 8, Registered Nurse Grade 4, Clinical Nurse Specialist, Clinical Nurse Educator, Nurse Educator, Nurse Practitioner and CNC who holds a continuing education qualification (grad cert, grad diploma, masters or doctorate - refer to Table 3 – Relevant Graduate Certificate, Graduate Diploma, Masters or Doctorate) in addition to the qualification leading to registration shall be paid a continuing education allowance, subject to the following conditions set out below:
(b) The allowance is only payable where the qualification is accepted by the Employer to be directly relevant to the competency and skills used by the nurse/midwife in the duties of the position.
(c) An Employee holding more than one relevant qualification is only entitled to one allowance, being the allowance of the highest monetary value.
(d) The Employee claiming entitlement to a qualification must provide evidence to the Employer that they hold that qualification. Payment of such allowance shall be payable on the first full pay period on or after the date evidence of such qualification is provided by the Employee to the Employer.
(e) Subject to the provisions in paragraphs (a)-(d) of this subclause, an Employee who holds a graduate certificate or graduate diploma as recognised by the Employer and relevant to the Employee’s current role shall be paid an allowance as set in out in Table 2 – Other Rates and Allowances (Part B).
(f) Subject to the provisions in paragraphs (a)-(d) of this subclause, an Employee who holds a masters or doctorate as recognised by the Employer and relevant to the Employee’s current role shall be paid an allowance as set in out in Table 2 – Other Rates and Allowances (Part B).
(g) The course of study must be assessed by the Employer as being of equivalent standard to a post graduate certificate. If the qualification was received prior to January 1990 the Employee will also need to produce evidence to support qualification is to the equivalent standard to a post graduate certificate
(h) Allowances are not to be included in the Employee’s ordinary rate of pay. The allowance is not payable during periods of paid leave taken by the Employee but they will be paid on ADO’s.
(i) Part- time Employees will be entitled to be paid the qualification allowance on a pro-rata basis.
(j) Where an Employee is engaged as a casual this allowance shall not apply

Special Allowances. (a) A registered nurse in charge during the day, evening or night of a hospital having a daily average of occupied beds of less than 100 shall be paid, in addition to her or his appropriate salary, whilst so in charge, the sum set out in Item 1 of Table 2 - Other Rates and Allowances, of (Part B Monetary RatesB), per shift.
(b) A registered nurse in charge of a shift in a ▇▇▇▇ or unit during the day, evening or night in the absence of the Nursing Unit Manager shall be paid, in addition to her or his appropriate salary whilst so in charge the sum set out in Item 2 of Table 2-Other Rates & Allowances, 2 (Part B) per shift. (b) An employee required to be on call on rostered days off in accordance with subclause 6.15(b) of Clause 6, Hours of Work and Free Time of Employees other than Directors of Nursing, shall be paid the sum set out in Item 4 of Table 2 (Part B) for each period of 24 hours or part thereof provided that only one allowance shall be payable in any period of 24 hours.
(c) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in Item 5 of Table 2 (Part B) provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.
(d) Where an employee on call leaves the hospital and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances the allowance per kilometre payable shall be the rate set out in Table 2determined by the Australia Taxation Office for business kilometres claimed when making a deduction using the cents per kilometre method. The provisions of this paragraph shall apply to all employees.
(e) This subclause shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursing.

(b) An employee required by ▇▇▇▇▇ Rehabilitation Hospital to be on call between rostered shifts or ordinary hours on rostered days off in accordance with subclause 6.15(b) of Clause 6, Hours of Work and Free Time of Employees other than Directors of Nursing, a Saturday shall be paid the sum set out in item 3 of Table 2 for each period of 24 hours or part thereof provided that only one allowance shall be payable in any period of 24 hours.
(c) An employee required to be on call between rostered shifts or ordinary hours on a Sunday, public holiday or any day on which they are not rostered to work, shall be paid the sum set out in item 4 of Table 2 for each period of 24 hours or part thereof provided that only one allowance shall be payable in any period of 24 hours.
(d) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in item 5 of Table 2 provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.

(b) A registered nurse in charge of a shift in a ▇▇▇▇ or unit beds during the day, evening or night in the absence of the Nursing Unit Manager a senior nurse shall be paid, in addition to her or his their appropriate salary salary, whilst so in charge charge, the sum as set out in Item 1, of Table 2-Other Rates & Allowances, 2 of Part B per shift. This subclause shall only apply where the registered nurse is in charge of one or more other nurses in the ▇▇▇▇ or unit in question.
(cb) This subclause shall not apply to registered nurses holding classified positions of a higher grade than that of registered nurseclinical nurse specialist.
(a) An employee required by their the employer to be on call otherwise than as provided for in paragraph (b) and (c) hereof shall be paid the sum as set out in Item 2 of Table 2 of Part B for each period of 24 hours hour or part thereof provided with a minimum payment of eight hours at that only one allowance shall be payable in any period of 24 hoursrate.
(b) An employee required to be on call on rostered days off in accordance with paragraph (c) of subclause 6.15(b(xvii) of Clause 64, Hours of Work and Free Time of Employees other than Other Than Directors of Nursing, shall be paid the sum as set out in Item 3, of Table 2 of Part B for each period of 24 hours hour or part thereof provided with a minimum payment of eight hours at that only one allowance shall be payable in any period of 24 hoursrate.
(c) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum as set out in Item 4, of Table 2 provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.Part B.
(d) Where an employee on call leaves the hospital their place of work and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances circumstances, the allowance payable shall be the rate set out in Table 2prescribed from time to time by the Ministry for a "casual" user. The provisions of this paragraph shall apply to all employees.
(e) This subclause shall not apply to a Director Nurse Managers classified at Grade 4 or above provided that the allowances prescribed in subclauses (a) and (b) of Nursingthis subclause shall be paid to Nurse Managers classified at Grade 4, Subsidiary Hospital Director Grade 5 and Grade 6 when required to remain on call for the purpose of Nursing, Deputy Director the performance of Nursing or Assistant Director of Nursingclinical duties.
(aiii) A registered nurse who is designated to be in charge of a ▇▇▇▇ or unit during day, evening or night shifts, when the Nursing Unit Manager is not rostered for duty, shall be paid an allowance as set out in Item 5, of Table 2 of Part B per shift. Provided that the allowance shall also be paid when the Nursing Unit Manager is rostered on duty if the day to day clinical management role for the shift is delegated to a designated registered nurse. Provided further that the allowance shall also be paid in the absence of a Nurse Manager in facilities where the Nurse Manager undertakes the functions usually carried out by a Nursing Unit Manager.
(iv) A registered nurse who is designated to be in-charge of a ▇▇▇▇ or unit when the Nursing Unit Manager is not rostered for duty and who is also designated to be in-charge of a hospital with the facility of less than 100 a hundred beds during the day, evening or night on the same shift shall be paid an allowance per shift of the sum as set out in Item 6, of Table 2-Other Rates & Allowances2 of Part B per shift. This subclause Provided that this allowance shall only apply also be paid in facilities where the registered nurse is Nurse Manager undertakes the functions usually carried out by a Nursing Unit Manager.
(a) An employee who makes their services available and participates in charge an approved roster to provide emergency telephone counselling outside their normal rostered ordinary hours shall receive the payments prescribed in paragraphs (b), (c) and (d) of one or more other nurses in the ▇▇▇▇ or unit in questionthis subclause.
(b) An employee rostered to be on call shall be paid the sum as set in Item 2 of Table 2 of Part B for each hour or part thereof with a minimum payment of eight hours at that rate. Provided that an employee rostered on call on rostered days off shall be paid the sum as set in Item 3, of Table 2 of Part B for each hour or part thereof with a minimum payment of eight hours at that rate.
(c) If during such an on call period prescribed in paragraph (b) of this subclause an employee is required to provide telephone counseling to a client, such employee shall be entitled to the following payment in addition to the payment in the said paragraph (b):
1. An employee on call for telephone counseling for up to 8 hours and is required to provide telephone counseling, such employee is to be paid one hour at ordinary rates (excluding penalties). If an employee receives more than one call to provide telephone counseling, no additional payment is to be made.
2. An employee on call for telephone counseling for 8-16 hours and is required to provide telephone counseling, such employee is to be paid two hours at ordinary rates (excluding penalties). If an employee receives more than one call to provide telephone counseling, no additional payment is to be made.
3. An employee on call for telephone counseling for 16-24 hours and is required to provide telephone counseling, such employee is to be paid three hours at ordinary rates (excluding penalties). If an employee receives more than one call to provide telephone counseling, no additional payment is to be made.
(d) An employee called out during the period of on call shall be entitled to the prescriptions of Clause 24, Overtime.
(vi) A registered nurse who is designated in-charge of a facility of greater than 100 beds during an evening or night shift Monday to Friday or any Saturday or Sunday shift shall be paid an allowance per shift as set out in Item 7, of Table 2 of Part B. This subclause allowance shall not apply to registered nurses holding classified positions of a higher grade than Clinical Nurse Grade 2. The employer shall not use this provision on a permanent basis in place of appointing a registered nurse Nurse Manager.

Special Allowances. (c) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in Table 2 provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a11.2(a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.
(d) Where an employee on call leaves the hospital and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances the allowance payable shall be the rate set out in Table 2determined by the Australian Taxation Office. The provisions of this paragraph shall apply to all employees.
(e) This subclause shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursing.

(a) An employee required by their employer to be on call otherwise than as provided for in paragraph (b) and (c) hereof shall be paid the sum set out in Item 3 of Table 2 for each period of 24 hours hour or part thereof provided with a minimum payment of eight hours at that only one allowance shall be payable in any period of 24 hoursrate.
(b) An employee required to be on call on rostered days off in accordance with subclause 6.15(b(xv)(b) of Clause 6, Hours 4 of Work and Free Time of Employees other than Directors of Nursing, the Award shall be paid the sum set out in Item 4 of Table 2 for each period of 24 hours hour or part thereof provided with a minimum payment of eight hours of at that only one allowance rate. The payment for a 24 hour period of on call shall be payable in any period of 24 hours$120.
(c) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in Item 5 of Table 2 provided that no allowance shall be paid if, during a period of 24 hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break2.
(d) Where an employee on remote call leaves the hospital and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances the allowance payable shall be the transport rate set out in Table 2prescribed from time to time by the NSW Health Department. The provisions of this paragraph shall apply to all employees.
(e) This subclause shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursing.. (iii)
(a) A registered nurse who Where a Director of Nursing is designated required by the hospital to be in-charge of a ▇▇▇▇ or unit when the Nursing Unit Manager is not rostered for duty and who is also designated to be in-charge of a hospital with less than 100 beds during the day, evening or night on the same shift perform radiographic duties they shall be paid in addition to their appropriate salary an allowance per shift of the sum set out in Item 6 of Table 2-Other Rates & Allowances. This subclause shall only apply where the registered nurse is in charge of one or more other nurses in the ▇▇▇▇ or unit in question2 per week.
(b) This The allowance prescribed by paragraph (a) of this subclause shall not apply to registered nurses holding classified positions an employee who relieves the Director of Nursing for a higher grade period of one week or more.
(c) An employee who is performing radiographic duties in the absence of the Director of Nursing for a period of less than one week shall be paid in addition to his or her appropriate salary a daily allowance of a registered nurse the sum set out in Item 7 of Table 2; provided that the maximum allowance per week payable in accordance with this paragraph shall not exceed the sum set out in Item 8 of Table 2.
(d) The allowance prescribed by this subclause shall be regarded as part of the salary for the purpose of this award.
(e) Provided that this allowances provided for in this subclause shall only be paid to employees who had been in receipt of the allowance prior to 1 July 1996.

(a) An employee required by his or her Employer to be on call otherwise than provided in (iii) (b) and (iii) (c) hereof shall be paid the sum as set in Table Allowances, at Appendix 1, for each period of 24 hours or part thereof provided that only one allowance shall be payable in any period of 24 hours.
(b) An employee required to be on call rostered days off shall be paid the sum as set in Table 2 Allowances, at Appendix 1, for each period of 24 hours or part thereof provided that only one allowance shall be payable in any period of 24 hours.
(c) The parties recognise the importance of employees being afforded the opportunity to take a meal break, noting however that where an Employee is required and authorised by the Employer to remain on call during a meal break, such employee shall be paid an allowance as set out in Table 2 Allowances, at Appendix 1. If an employee is recalled during such meal break they shall be paid at overtime rates for the total period of the meal break.
(d) Where an Employee on call leaves the hospital and is recalled to duty, he or she shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances that the allowance payable shall be in accordance with the published ATO rates for motor vehicle usage. The provisions of this paragraph shall apply to all employees.
(e) The provisions of this paragraph shall apply to all classifications up to and inclusive of the Nurse Unit Manager.

(iv) This subclause sub-clause shall not apply to registered nurses holding classified positions of a higher grade than that of registered nursea Registered Nurse/Clinical Nurse Specialist.
(ai) An employee required by their employer to be on call otherwise than as provided for in paragraph (bii) shall be paid the sum set out in Table 2 for each period of 24 twenty four (24) hours or part thereof provided that only one one
(1) allowance shall be payable in any period of 24 twenty four (24) hours.
(bii) An employee required to be on call on rostered days off in accordance with subclause sub-clause 6.15(b) of Clause 6, Hours of Work and Free Time of Employees other than Directors of NursingWork, shall be paid the sum set out in Table 2 for each period of 24 twenty four (24) hours or part thereof provided that only one (1) allowance shall be payable in any period of 24 twenty four (24) hours.
(ciii) An employee who is directed to remain on call during a meal break shall be paid an allowance of the sum set out in Table 2 provided that no allowance shall be paid if, during a period of 24 twenty four (24) hours including such period of on call, the employee is entitled to receive the allowance prescribed in 12.2(a12.2(i) above. If an employee is recalled to duty during such meal break, they shall be paid at overtime rates for the total period of the meal break.
(div) Where an employee on call leaves the hospital and is recalled to duty, they shall be reimbursed all reasonable fares and expenses actually incurred provided that where an employee uses a motor car in these circumstances the allowance payable per kilometre shall be the rate set out outlined in Table 22 – Other Rates and Allowances. The provisions of this paragraph shall apply to all employees.
(ev) This subclause sub-clause shall not apply to a Director of Nursing, Subsidiary Hospital Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursing.
