Common use of Special Single Shift Clause in Contracts

Special Single Shift. When the Employer produces evidence in writing to the appropriate Local Union of the Union of a bona fide job requirement for a public agency which certifies that work can only be performed outside the normal shift hours, and notifies the appropriate Local Union of the Union by mail at least three (3) days prior to the start of such special shift, the Employer may initiate such special shift of (8) consecutive hours (not in conjunction with any other shift), exclusive of meal period, Monday through Friday. The straight time rate for such special shift shall be three dollars ($3.00) per hour above the appropriate straight time rate otherwise specified in this Agreement but shall not exceed the prevailing rate as adopted by such public agency for this specific project. Section 5. The Union agrees to waive the sick leave benefits set forth in Labor Code Sections 245-249 as well as the benefit of any future local sick leave ordinances or statutes that may be waived through collective bargaining.
