Specific Services-Related Commitments. The Operator commits to the Region that the Services as provided in the Facilities will: (a) comply in all respects with this Agreement; (b) be performed by fully trained, qualified and Accredited personnel and staff (on an ongoing basis); (c) be performed using Equipment which is in good condition, which is suitable and adequate for the use being made and which has received such approvals and licenses as are required for proper operation in accordance with the requirements of all regulatory authorities and, the manufacturer, where applicable; and (d) be performed in a manner which reasonably ensures that all medical records related to Services performed at the Facilities will be transmitted accurately and expeditiously (by courier or electronic means) to all those persons responsible for the ongoing care, if any, of patients, in every case and the Region, when requested and in compliance with the HIA.
