Common use of Specifications and Requirements Clause in Contracts

Specifications and Requirements. The Democracy Suite Voting System (“System,” as defined in Exhibit A) is certified for use in California by the California Secretary of State pursuant to Elec. Code § 19001 et seq., 2 CCR § 20700 et seq., and the California Voting System Standards. Contractor shall ensure the System is certified and compliant with the current and valid certification and Administrative Approvals pursuant to 2 CCR § 20707 or other relevant law or regulation issued by the California Secretary of State at the time of Agreement execution and at the time of any upgrades to the System. The System must comply with all applicable state and federal requirements, including, but not limited to, the voting system requirements as set forth in the California Elections Code, the Help America Vote Act of 2002 and the California Code of Regulations in effect at the time of the System’s certification.
