Upon arriving at the collection site, the Officer to be tested shall present the collection site person with proper identification to ensure that he/she is positively identified as the person selected for testing by presenting a driver's license or other photo ID. If the Officer's identity cannot be established, the collection site person shall not proceed with the collection, and the City shall be notified. If the Officer is unable to produce the required amount of urine for testing, the collection site person shall direct the officer to drink fluids and after a reasonable time again attempt to provide a sample using a fresh specimen bottle. The original specimen shall be discarded. The medical evaluator shall report his or her findings to the MRO. Upon completion of the examination, the MRO shall report his or her conclusions to the Personnel Department in writing. Whenever there is reason to believe that a particular Officer has altered or substituted the specimen, second specimen shall be obtained as soon as possible under the direct observation of a collection site person of the same gender. After the urine specimen is provided, both the Officer being tested and the collection site person shall keep the specimen in view at all times prior to its being sealed and labeled. If separate from the label, the tamper-proof seal shall also be applied. The Officer shall, in the presence of the collection site person, initial the identification label on the specimen bottle for the purpose of certifying that it is the specimen collected from him or her. The collection site person shall, in the presence of the Officer, enter on the drug testing custody and control form all information identifying the specimen. The collection site person shall sign the form certifying that the collection was accomplished according to SAMHSA procedures. The Officer shall be asked to read and sign a statement on the drug testing custody and control form certifying that the specimen identified as having been collected from him or her is in fact the specimen he or she provided. The Officer will also be required to read and sign a consent and release form authorizing the collection of the specimen, analysis of the specimen for designated controlled substances and release of the test results to the Office of Internal Investigation. The collection site person shall complete the chain of custody portion of the drug testing custody and control form to indicate receipt of the specimen from the Officer and shall certify proper completion of the collection process. If the specimen is not immediately prepared for shipment, the collection person shall ensure that it is appropriately safeguarded during temporary storage. If the Officer refuses to cooperate with the collection process, the collection site person shall inform the Personnel Department and shall document the non-cooperation on the drug testing custody and control form. If the sample is being collected from an Officer in need of medical attention (e.g., as part of a post-accident test given in an emergency medical facility), necessary medical attention shall not be delayed in order to collect the specimen.

(The original specimen, if any, should be discarded, unless it was out of temperature range or showed evidence of adulteration or tampering.) If the drug testing individual is still unable to provide forty-five (45) milliliters of urine, he/she will be taken out of service and a medical evaluation will be conducted within five (5) business days by a licensed physician who has the expertise in this type of medical issue, and is approved by the Employer to determine if there is a medical reason for the inability to provide a specimen. If it is not determined that there is a medical reason, the individual will be treated as having refused to take the test. If the employee fails for any reason to provide forty-five (45) milliliters of urine, the collection agent should contact a third party administrator (TPA) and either the District Safety and Health Manager or another Employer designee. The regulations specify the privacy procedures and the reasons to believe that a specimen has been adulterated which includes, but is not limited to, conduct clearly and unequivocally indicating an attempt to substitute or adulterate the sample, e.g., abnormal urine color or urine temperature outside the acceptable range. All specimens suspected of being adulterated shall be packaged and forwarded to the laboratory for testing. In the event of suspected specimen adulteration, a second specimen will be immediately collected under direct observation and the entire procedure should be repeated including initiation of a new custody and control form certifying that the specimen identified as having been collected from him or her is in fact the specimen he or she providedand separate packaging for shipping. The Officer will also be required If an employee refuses to read and sign provide a consent and release form authorizing the collection of the second specimen, analysis of the specimen for designated controlled substances it shall be noted as a refusal to test and release of the test results to the Office of Internal Investigationshall be a terminable offense. Specimen handling (from one (1) authorized individual or place to another) will always be conducted using chain-of-custody procedures. Every effort must be made to minimize the number of custody portion people handling specimens. Both specimen containers shall be sealed and then forwarded to an approved laboratory for testing. When a return-to-duty or follow-up test is being conducted, the collection process may be observed. If observed, the observer shall be the same gender as the employee being tested. When a test kit is received by a laboratory, the thirty (30) milliliter sealed urine specimen container shall be removed immediately for testing. The shipping container with the remaining sealed container shall be immediately placed in secure refrigerated storage. If an employee is told that the first (1st) sample tested positive, the employee may, within seventy-two (72) hours of receipt of actual notice, request that the second (2nd) urine specimen be forwarded by the first (1st) laboratory to another independent and unrelated HHS approved laboratory of the drug parties' choice for GC/MS confirmatory testing custody and control of the presence of the drug. If an employee chooses to have the second (2nd) sample analyzed, he/she shall at that time execute a special checkoff authorization form to indicate receipt insure payment by the employee. For those employees who choose to have the second (2nd) specimen tested, disciplinary action can only take place after the MRO verifies the first (1st) test as positive and the second (2nd) laboratory confirms the presence of the specimen from drug. However, the Officer and shall certify proper completion employee must be taken out of service once the collection processfirst (1st) test result is verified as positive by the MRO while the second (2nd) test is being performed. All specimens suspected of being adulterated shall be packaged and forwarded to the laboratory for testing. If the Officer individual is unable to produce the required amount pro- vide forty-five (45) milliliters of urine for testingurine, the collection site person agent shall direct the officer individual to drink fluids and after fluids, not to exceed forty (40) ounces distributed reasonably over a reasonable time again attempt period not to provide exceed three (3) hours or until a sample using a fresh sufficient specimen bottleis provided, whichever occurs first. (The original specimen shall specimen, if any, should be discarded. , unless it was out of temperature range or showed evidence of adulteration or tamper- ing.) If the Officer individual is still unable to provide a complete specimenforty-five (45) milli- liters of urine, the following rules apply:
a) In the case he/she will be taken out of a reasonable cause test, the Officer shall remain at the collection site service and continue to consume reasonable quantities of fluids until the specimen has been provided or until the expiration of a period up to 3 hours from the beginning of the collection procedure.
b) If the Officer cannot provide a complete sample within the up to 3-hour period and the Officer claims a medical claims a medical condition as the cause, then the MRO shall refer the Officer for a medical evaluation will be conducted within five (5) business days by a li- censed physician who has the expertise in this type of medical issue, and is approved by the Employer to develop pertinent information concerning whether determine if there is a medical reason for the Officer's inability to provide a specimen is genuine or constitutes a refusal to provide a specimen. Upon completion of the examinationreason, the MRO shall report his individual will be treated as hav- ing refused to take the test. The regulations specify the Personnel Department in writing. If an employee is told that the first (1st) sample tested positive, the employee may, within seventy-two (72) hours of receipt of actual notice, request that the second (2nd) urine specimen be forwarded by placement of a tamperproof seal over the bottle cap first (1st) laboratory to another independent and down the sides unrelated HHS approved laboratory of the bottle) and labeled in parties’ choice for GC/MS confir- matory testing of the presence of the Officerdrug. If an employee chooses to have the second (2nd) sample analyzed, he/she shall at that time execute a special checkoff authorization form to insure payment by the employee. The collection site person shall complete the chain of custody portion of the drug testing custody and control form to indicate receipt of the specimen from the Officer and shall certify proper completion of the collection processbeing performed. If the specimen second (2nd) laboratory report is not immediately prepared for shipmentnegative, the collection person shall ensure that it is appropriately safeguarded during temporary storage. If the Officer refuses to cooperate with the collection process, the collection site person shall inform the Personnel Department and shall document the non-cooperation on the drug testing custody and control form. If the sample is being collected from an Officer in need of medical attention (e.g., as part of a post-accident test given in an emergency medical facility), necessary medical attention shall employee will not be delayed in order charged for the cost of the second (2nd) test and will be reimbursed for all lost time. It is also understood that if an employee opts for the second (2nd) specimen to collect the specimenbe tested, any contractual time limits on disciplinary action are waived.

The medical evaluator shall report his collection agent provides the employee with a new, sealed kit selected by the employee. The employee will provide their specimen in a stall or her findings otherwise partitioned area that allows for privacy. The City agrees to recognize employee’s right to privacy while being subjected to the MROcollection process at all times and at all collection sites.
