Spending Exceptions to Rebate. To the extent that Gross Proceeds of the Lease are determined to have been allocated to Expenditures in a manner that satisfies any of the following spending exceptions, investment earnings allocable to such Gross Proceeds need not be rebated to the United States of America. Use of the spending exceptions is not mandatory.
