Standard of Proof. A) Allegations of breaches of these Halls of Residence Discipline Regulations need not be proved ‘beyond a reasonable doubt’. The standard of proof applied is the ‘balance of probabilities’ which means that, when assessing the evidence objectively, the Decision-Makers view is that it is more likely than not that the allegation of misconduct is proved; B) The Decision-Maker’s decision is final as to the facts; C) if applicable account will be taken of clause 2.3 E); and D) where a person against whom allegations have been made is not aware of the identity of all those who have given evidence, due weight to this factor will be given and your responses in those circumstances.
