Common use of State Procedures Clause in Contracts

State Procedures. The Recipient agrees to administer each Project in accordance with 49 U.S.C. § 5311 as amended by SAFETEA‑LU. Except to the extent that FTA determines otherwise in writing, the provisions of FTA Circular 9040.1E, “Nonurbanized Area Formula Program Guidance and Grant Application Instructions,” including any revisions thereto, and other applicable FTA laws, regulations, and directives apply to the Project to the extent those provisions are consistent with 49 U.S.C. § 5311 as amended by SAFETEA‑LU. To the extent, however, that 49 U.S.C. § 5311 as amended by SAFETEA‑LU or any existing or subsequent Federal law or regulation conflicts with the provisions of FTA Circular 9040.1E or any subsequent revision thereto, the latest Federal law or regulation will apply.
