Common use of Statement of Issue Clause in Contracts

Statement of Issue. The Parties shall communicate in advance of the arbitration hearing in an attempt to agree on a joint submission of the issue(s) for arbitration. If the Parties fail to agree on a joint submission, each Party will prepare a statement of what it believes the issue(s) to be. The Parties will exchange these statements of the issue(s) at least five (5) days in advance of the scheduled arbitration hearing date. The arbitrator will have final authority to determine the issue(s) to be decided.
