Common use of STATEWIDE ACHIEVEMENT TESTING Clause in Contracts

STATEWIDE ACHIEVEMENT TESTING. When CONTRACTOR is a nonpublic school, CONTRACTOR shall, in accordance with Education Code section 60640 et. seq. administer all Statewide assessments within the California Assessment of Student Performance and Progress (“CAASP”), Desired Results Developmental Profile (“DRDP”), California Alternative Assessment (“CAA”), achievement and abilities tests (using LEA- authorized assessment instruments), the Fitness Gram, and the English Language Proficiency Assessments for California (“ELPAC”), as appropriate to the student, and mandated by ▇▇▇ pursuant to LEA guidelines as well as state and federal laws and regulations, unless ▇▇▇ notifies CONTRACTOR that it will administer such Statewide assessments. When CONTRACTOR is a nonpublic school, CONTRACTOR is subject to the alternative accountability system developed pursuant to Education Code section 52052, in the same manner as public schools. Each LEA student placed with CONTRACTOR by the LEA shall be tested by qualified staff of CONTRACTOR in accordance with that accountability program. ▇▇▇ shall provide test administration training to CONTRACTOR’s qualified staff; CONTRACTOR shall attend LEA test training and comply with completion of all coding requirements as required by ▇▇▇. Contractor shall report the test results to the CDE as required by Education Code section 56366(a)(8)(A). Where CONTRACTOR is a nonpublic school, CONTRACTOR shall administer all statewide achievement tests as mandated by the LEA and pursuant to the LEA guidelines, as well as state and federal laws and regulations, unless ▇▇▇ notifies CONTRACTOR that it will administer such assessments.
