STIPULATION OF DISMISSAL WITH PREJUDICE. The parties shall deliver a stipulation of dismissal with prejudice to terminate the case entitled Drey▇▇'▇ ▇▇▇nd Ice Cream, Inc. and Edy's Grand Ice Cream v. Ben & Jerry's Homemade, Inc. pending in the United States District Court, Northern District of California, Case No. C-98-3357 FMS, in the form of Exhibit I attached hereto. Each party shall be responsible for their own attorney's fees, costs and expenses relating to said litigation. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the other provisions shall nevertheless be in full force and effect without being impaired or invalidated in any way.
