Common use of Storage of Documents Clause in Contracts

Storage of Documents. 14.1 After completing the work, we may be entitled to keep all your papers and documents while there is still money owed to us for charges and disbursements. 14.2 We will keep our file of your papers (except those papers you ask to be returned to you) in a secure storage area under our control for a minimum of 6 years from the date of the final invoice, after which time they will be securely destroyed. This time will vary depending on the type of case we deal with for you. We will not destroy documents you ask us to deposit in safe custody. However, should any of your documents be lost or damaged as a result of events beyond our reasonable control we will not be liable for their replacement or for any resultant loss. 14.3 If we take papers or documents out of storage in relation to continuing or new instructions to act for you, we will not normally charge for such retrieval. However, we may charge you for: time spent producing stored papers that are requested; and reading, correspondence or other work necessary to comply with your instructions in relation to the retrieved papers. Unless otherwise agreed with you in writing, those charges will be at our hourly rates applicable at that time. 14.4 If you request retrieval of your file for your own personal reasons or to obtain documents or information which we have previously sent to you, we will normally charge an administration fee.
