Student Count Clause Samples

The Student Count clause defines how the number of students is determined for the purposes of the agreement. Typically, it specifies the method and timing for counting enrolled students, such as using enrollment records on a particular date or averaging attendance over a period. This clause ensures both parties have a clear and consistent basis for calculating fees, allocating resources, or meeting contractual obligations, thereby preventing disputes over student numbers.
Student Count. Students who are officially on a class roster on the count day are the only students that may be considered part of the teacher’s class load. Only students who are part of the regularly-attending class can be counted towards overload. Students who have been long-term suspended, expelled or withdrawn (even if their name has not been officially taken off the class list) may not be counted as overload. Students assigned to the classroom to provide assistance to the teacher (e.g., TAs) will not be included in the class counts used to calculate for overload.

The County hereby establishes a level of service of 110% for each public school in each SCSA, as the desired level of service for each school type (elementary, middle, combination, alternative and high) based upon the lesser of total FISH capacity or core cafeteria capacity.
