Study and Report Phase. A. Engineer shall: 1. Consult with Owner to define and clarify Owner’s requirements for the Project and available data. 2. Advise Owner as to the necessity of Owner’s providing data or services of the types described in Exhibit B which are not part of Engineer’s Basic Services, and assist Owner in obtaining such data and services. 3. Identify, consult with, and analyze requirements of governmental authorities having jurisdiction to approve the portions of the Project designed or specified by Engineer, including but not limited to mitigating measures identified in the environmental assessment. 4. Identify and evaluate four (as identified in Attachment No. 1) alternate solutions available to Owner and, after consultation with Owner, recommend to Owner those solutions which in Engineer’s judgment meet Owner’s requirements for the Project. 5. Prepare a report (the “Report”) which will, as appropriate, contain schematic layouts, sketches and conceptual design criteria with appropriate exhibits to indicate the agreed-to requirements, considerations involved, and those alternate solutions available to Owner which Engineer recommends. This Report will be accompanied by Engineer’s opinion of Total Project Costs for each solution which is so recommended for the Project with each component separately itemized, including the following, which will be separately itemized: opinion of probable Construction Cost, allowances for contingencies and for the estimated total costs of design, professional, and related services provided by Engineer and, on the basis of information furnished by Owner, allowances for other items and services included within the definition of Total Project Costs. 6. Perform or provide the following additional Study and Report Phase tasks or deliverables: As identified in Attachment No. 1 7. Prepare a report (the “"Report”") which will, as appropriate, contain schematic layouts, sketches and conceptual design criteria with appropriate exhibits to indicate the agreed-to requirements, considerations involved, and those alternate solutions available to Owner which Engineer recommends. Study and Report Phase. A. Engineer After written authorization to proceed, ARCHITECT shall:

Provide general economic analysis of AGENCY ’S requirements applicable to various alternatives. Prepare a Report with appropriate exhibits indicating clearly the considerations involved and the alternative solutions available to AGENCY and setting forth ARCHITECTS findings and recommendations with opinions of probable costs. Furnish seven (7) copies and one (1) digital copy (CD) of the Report and present and review it, in person, with AGENCY representatives. Preliminary Design Phase After written authorization to proceed with the Preliminary Design Phase, ARCHITECT shall: In consultation with AGENCY and on the basis of the accepted Report, determine the Scope of a Project. Prepare preliminary design documents consisting of final design criteria, preliminary drawings and outline specifications. Based on the information contained in the preliminary design documents, submit a revised opinion of probable cost for each Project including construction cost, contingencies, compensation for all professionals and ARCHITECTS, cost of land, rights-of-way, and compensation for or damages to properties and interest and financing charges (all of which are not part hereinafter called “Project Costs”). Furnish seven (7) copies and one (1) digital copy (CD) of Engineer’s Basic Servicesthe above preliminary design documents and present and review them in person with AGENCY representatives. Furnish copies and solicit review comments from interested governmental and regulatory agencies and utility companies. Final Design Phase After written authorization to proceed with the Final Design Phase, ARCHITECT shall: On the basis of the accepted preliminary design documents prepare for incorporation in the Contract Documents, final drawings to show the character and scope of the work to be performed by Contractors on the Project (hereinafter called “Drawings”), and Specifications. Furnish to AGENCY such documents and design data as may be required for, and prepare the required documents so that AGENCY may obtain approvals of such governmental authorities as having jurisdiction over design criteria applicable to each Project, and assume Architectural and planning responsibility in obtaining such approvals by participating in submissions to and negotiations with appropriate authorities. Advise AGENCY of any adjustments to its latest opinion of probable Project Cost caused by changes in scope, design requirements or construction costs and furnish a revised opinion of probable Project Cost based on the Drawings and Specifications. Prepare bid forms, notice to bidders, instructions to bidders, general conditions and supplementary conditions, and assist Owner in obtaining such data the preparation of the other related documents. Prepare routine application for approvals and services.
3. Identify, consult with, and analyze requirements of permits from all governmental authorities having jurisdiction over each project and from others as may be necessary for completion and operation of each project. However, ARCHITECT upon certification to approve the AGENCY that the application or permit is not routine, may have this service be considered as additional service. This shall include the furnishing of back-up data as required during the various permit application procedures. Furnish seven (7) copies and one (1) digital copy (CD) of the above mentioned documents and present and review them in person with AGENCY representatives. Bidding or Negotiating Phase Obtain bids from each separate prime Contract for construction or equipment. Consult with and advise AGENCY as to the acceptability of subcontractors and other persons and organizations proposed by the prime Contractor(s) (hereinafter called “Contractor(s)”) for those portions of the Project designed or specified work as to which such acceptability is required by Engineer, including but not limited the Contract Documents. Consult with and advise AGENCY as to mitigating measures identified in the environmental assessment.

5. 1.1.5 Prepare a report (the “"Report”") which willwill contain the statement of OWNER's requirements for the Project and, as appropriate, will contain schematic layouts, sketches and conceptual design criteria with appropriate exhibits to indicate the agreed-to requirements, considerations involved, involved and those alternate solutions available to Owner OWNER which Engineer ENGINEER recommends. This Report will be accompanied by Engineer’s opinion of Total Project Costs for each solution which is so recommended for the Project with each component separately itemized, including the following, which will be separately itemized: opinion of probable Construction Cost, allowances for contingencies and for the estimated total costs of design, professional, and related services provided by Engineer and, on the basis of information furnished by Owner, allowances for other items and services included within the definition of Total Project Costs.
6. Perform or provide the following additional Study and Report Phase tasks or deliverables: As identified in Attachment No. 1

B. Engineer’s services under 1.1.8 Submit the Report within the stipulated period indicated herein. The duties and responsibilities of ENGINEER during the Study and Report Phase will be considered complete on as set forth in this paragraph 1.1 are amended and supplemented as follows: • Review 30% drawings and technical provisions related to the date when NICTD Main Street station • Participate in one or more meetings with Town officials and staff to review constraints, provide design guidance, develop a preferred design concept for the final copies Main Street station. • Prepare documentation of meetings and design concept and generate an initial betterments list. • Submit betterments list to the West Lake Corridor Joint Venture • In coordination with Town officials and staff, participate in one or more reviews of drawings prepared by NICTD’s Joint Venture and prepare documentation of response to revised Report have been delivered to Ownerdrawings.
